  1. That's the best news I've had all day! Since leaving me two years ago she has already gone through a live-in partner and has now married another guy. Good grief!
  2. Asthma is not an excuse to overstay your visa. You're out of luck. Why would the US allow you to enter on a tourist when you have already violated your previous visa?
  3. Okay, so maybe I have been asking the wrong question here. I am in a situation where I have decided to move to the Philippines instead of bringing my fiance here to the US. (My fiance is ecstatic!) I had asked how to go about a Recognition of Foreign Divorce in the Philippines so I can marry there again. I was married 10 years ago in Philippines. I was sent a link for the information by a fellow VJ member. Here's the first paragraph of the Philippine law: JUDICIAL RECOGNITION OF FOREIGN DIVORCE IN THE PHILIPPINES There is no divorce in the Philippines, but when a divorce is validly obtained abroad and initiated by the foreign spouse, the Filipino spouse shall have the capacity to remarry under Philippine law. So as I read this the law does not pertain to me as I DID NOT INITIATE THE DIVORCE NOR AM I THE FILIPINO SPOUSE. So then am I free to marry in the Philippines as long as I can present an original divorce decree obtained in Hawaii USA to the Philippine authorities? In reading the Philippines law (above) the very first paragraph seems to not apply to me in me in this situation. MY FILIPINA FILED FOR DIVORCE AGAINST ME so I didn't initiate the divorce and obviously I am not the Filipino spouse. Your assistance in the matter will be greatly appreciated. Mahalo, David
  4. Okay so I posted this in the Philippines section and really didn't get an answer. So here we go again. I was married in Lapu Lapu in 2013. My filipina left me 2 years ago. I want to get my US divorce recognized by the Philippines. Does anyone have recommendations for an attorney and do I need an attorney in Cebu to file with the regional court there? Any recommendations for attorneys for this?
  5. I'm going back to the Philippines in August. I hope to find an attorney on the trip. I am just very uncomfortable hiring an attorney on-line. Too many scammers. I was hoping someone could make a recommendation for a reliable attorney. Good luck in your search. In the past few weeks I have made my mind up to move to the Philippines what with how America is falling apart.
  6. So I was married in the Philippines in 2013. My wife divorced me 2 years ago. I am looking for an attorney to file a RECOGNITION OF FOREIGN DIVORCE. I found one in Manila but he wants 50k php as a retainer. That sounds a little pricey to me. Also, is the filing to be done in a regional court and would it be better to find an attorney in Cebu where we were married? Does anyone know of an attorney that is to be trusted? Please advise. Mahalo
  7. So I was married 10 years ago in Philippines. My Filipina left me and the kids after 8 years. I am seriously thinking of moving to the PI. My new fiance thinks that would be great. But I think I would want to marry her there. How do I get my American Divorce recognized in the PI? I am the American. I know divorce is not an option in the PI. Any suggestions and how long will it take?
  8. That keeps changing itself. I don't know why. Yes, it is a K-1 visa. Thanks for the heads up. Mahalo, David
  9. Now I really have a situation, or do i? My Filipina fiance had passport photos taken at a Philippines "passport shop". She sent me one and I attached it to the K-1 Fiance application and submitted it. Now in hindsight I looked at the photo again and realized that she was smiling and her teeth were exposed. She has an appointment to get her Philippine Passport next week. The problem I have is as follows: 1.) Should she go ahead and get her Philippine passport using the same photo I submitted to USCIS or should she go have a passport photo retaken by a photo shop that knows what the hell they are doing and use that photo? 2.) If USCIS rejects the passport photo that I already submitted to them and requests a new photo and she has gotten her PI passport with the smiling photo will there be an issue? I know all photos are supposed to match up. 3.) If the Philippine Passport accepts the smiling photo should she just go ahead and use that? Or should I have her go and get a new passport photo taken that meets the USCIS criteria? 4.) If she does use the smiling photo a gets the PI passport and USCIS later rejects the smiling passport photo will she need to go back and get an updated PI passport that with the new photo so it matches up with the new photo? Sorry about the long story. Any questions or answers? Mahalo, David
  10. I know. That's just an expression. I have been on the bus, trike, Jeepney hobble hobble and every other means of transportation in the Philippines. Been thru this once. Done it and doing it again. Some people gotta lighten up... And PS, the Philippines has more laws, rules and regulations than probably any other country in the world. That's why I could never retire there...too damn many rules. hahaha
  11. I can't find our situation where the father is not present. Would you be so kind as to highlight that portion? Not I'm really confused.
  12. Wow that's what I thought but of course a "friend" of my fiances claims that she was denied because she didn't have the fathers consent. Thank you very much!
  13. Not sure if I put this is the right place. I am engaged and my fiance in the Philippines has two minor children. She has never been married (Thank God). I recently filed for the K-1 for my fiance. I want to bring her two minor children along with us to the US. Problem is the "father" is listed on the children's birth certificates. He absconded when the second child was born and has not been seen of heard from since....no contact what-so-ever- No idea where he went. Now I realize that to get the kids Philippine Passports (for K-2) visa we have a problem. How does my fiance get her two children PI passports when "father" has disappeared? What are the steps we need to take so she can obtain PI passports for the children. More attorneys, acts of congress, I can only imagine but I want to get this done. I have read that a court order granting her TOTAL custody of the children must be obtained. Where do I start? Is an attorney required? Anyone know of any attorneys in Makati? Please advise. Mahalo, David O
