Today I sent my I-824 for action on an approved I-130 petition for my husband. I'd like to see how many other VJers are in this process and maybe keep up with the progress of each on this thread. If you've already submitted your I-824, please respond with your date and keep the VJ community informed. This is a new requirement (Oct 06) for those with approved K3 and I-130 applications, so there is limited information on the Forum.

If someone knows how to start a timeline for us on this thread...please feel free to add it with some instrucctions.

Submitting I-824 is not a requirement, it's an option. Another option is to explicitly state when submitting the I-130 that although an I-129f will follow you want to approved I-130 to be sent to the DOS anyway.

Once your spouse has their K3 visa and enters the USA do they really want to make a trip back home to get an immigrant visa? Or would they prefer to adjust status? A large majority prefer the latter, which is why the policy to hold approved I-130s for K3 people was instituted.

Not necessarily......even if you explicitly stated that you want your approved I130 to be sent tothe NVC, it doesn't mean it will happen. Mine was retained and I had clearly indicated that I wanted it sent to the NVC. The USCIS service centers are a little confused about their own policy.

I did not fill in the section where it said.....if the beneficiary will be adjusting status in the US then fill in the following.......

I indicated very clearly that the petition should go to the Cairo, Egypt embassy abroad and in my coverletter of the I130 I stated that I wanted the petition to be sent to the NVC and then to the consulate aboad.....it was bolded......I was clear and I think they understood that because on my NOA2 it states that the above petition was approved and has been forwarded to the NVC.....however, they seem to be confused about their own policy because even though the NOA2 indicated that my petition was forwarded......it was never sent.

If they were supposed to retain the I130 then the NOA2 would have indicated that it was being retained due to an approved I129F.....as other VJers have indicated their notice states......

Thanks for sharing the detail of your experience.

I think it's been clear for awhile now that how question #22 on the petition is answered is irrelevant in this regard.

I agree with your assessment that your intention did get through, at least to someone, but that whoever was supposed to send the petition to the correct place did not get the message.

As a general principle cover letters should not be relied on to convey important information. Important information should be written on or attached directly to the form to which it applies. Still might not have helped in your situation, however.

I have just received e-mail notice of my I-130 and I-129F approvals, I will file my I-824 the same day the NOA 2 arrives, I am watching closely, I am hoping to get CR-1 now, before the fee increases take effect! In China it might not move fast enough. Mike ( I was under the impression that if you filed K-3 then they would hold all I-130's unless you filed the I-824. Part of the reason for having both processed at the same service center, they will know about the K-3. Telling them where you want the interview for the CR-1 doesn't stop them from holding the petition if you file K-3.)
