Just seeing if anyone has had any news.

I'm still waiting for the congressman to get back to me.

Jan 13 2004 - Entered US on VWP

Apr 5 2004 - Married! :D

July 18 2005 - AOS Interview using DORA

July 27 - received 1st NOA (I-130)

Sept 13 - Infopass appointment to inquire about missing NOA (I-485)

Sept 13 - Fingerprints taken

Sept 28 - Fingerprint results received. Processing has resumed.

Sept 30 - Received 70 day letter with appointment for EAD

Jan 29 2006 - Received decision - AOS denied

Feb 24 - Filed MTR

Feb 29 - Received receipt saying check had been cashed

Mar 31 - Letter from Congressman stating that USCIS had not received my MTR

Apr 3 - Faxed copy of MTR to Congressman's office

Apr 6 - Email stating that my case should be completed within 30 days

Apr 10 - MTR granted. I-485 and I-130 approved!

July 10 - Email Update - GC has been ordered.

July 14 - Email Update - Sending out approval notice for I-485.

July 31 - Received Approval notice for I-130.

Aug 03 - Green Card received!!!!!!!!!!! Wooooohoooooo!!

what is DORA anyway?

it seems that it's "AOS thru D.O.R.A (Dallas Office Rapid Adjustment)".. so what does that mean? Why is it "rapid"? Can anybody go thru that kind of service?

I don't know anything about DORA, but I see that you are from Amarillo.

I was an exchange student there. I went to Tascosa. I also went to Amarillo College for a year.

DORA is an experimental program being tested in the Dallas area to try and complete AOS approvals in 90 days or less. You must be in the area to use this program.

Well, what a mess.

I got my decision yesterday telling me I had been denied due to abandonment. They say they never recieved the additional evidence that I sent in. What I would like to know is, why did it take them this long to tell me that they hadn't recieved something in August?

Anyway, I can file a motion to reopen my case, which i am going to do.

Does anyone know which form I'd need? The letter was very vague.

I have no idea what form you'd need I'm afraid. It appears you certainly have a strong case to complain to your congressman though. Is this what happened:

- RFE received in August and evidence submitted;

See this link regarding DORA. Note that it's not a guarantee of AOS within 90 days, rather there's a good chance of it. Should the AOS not be completed within 90 days they give you an appointment where you can apply for and receive (on the same day) EAD and AP.

Yep, that's exactly what happened. I had wondered, also, why no mention of this way made at my infopass appointment, or with the 70th day letter.

Oh well, we'll just have to see what happens. Doesn't look like there is any way of getting around the $385 fee it is going to cost to reopen my case, though.

It does rather sound like a case of "the left hand not knowing.... etc.".

It occurs to me that one of the main points of DORA is to avoid RFE's: they shouldn't happen. Since the case file is submitted in person, it's checked by a case officer there and then. They inform you if you are missing any items and if you are, at least as I understand it, they'll send you away if they're not satisfied.

So I'm really surprised to hear you can get an RFE with DORA.

I take it, from your post, that you didn't attend the EAD/AP appointment. I'm increasingly getting the impression that this is a bad idea (that's no help now I know....). The way the 70th day letter is worded it comes across that it's optional - only if EAD/AP is required - but at least (maybe?) they can give you a clue as to what the hold up is. That said, I didn't get any info at mine - but at least they know I'm still on board.

I'm starting to waffle now - just quite confused by the whole thing. Sorry to hear about all your bad luck.

Before you appeal, I would suggest to call a lawyer and, above all, to make an Infopass Appointment to talk to an officer in person. Maybe it's something they can solve without you going through an official appeal...I don't know. It's worth a try, I guess.
