INFOPASS APPT. WTF?!! GRRRR!!!

I just got back from my Infopass appointment. I finally get up to the window and I tell the guy I'm looking for more info than the CSC phone line people can provide. I then tell him I have access to the web and can access my case status and USCIS processing times just fine, last time I called USCIS all they could seem to do was get online and read my case status and the processing times over the phone. He saw I had my NOA1 notice with me and asked for it. I told him it's been almost 5 months and I was trying to figure out when they might process my petition. He looked at my notice and said my NOA1 date is what they will use to determine processing order. I said well I know of people who filed in July and already have approval. So then he says "Ok would you like me to check the computer for you?" I said sure. So he gets on and says so you responded to the RFE that was sent, I said yes. So then he prints his screen and goes back to talk to his supervisor for a few minutes. Then he comes back and tells me that my RFE receipt date is my new NOA1 date!!! To which I reponded "HOLY #######!!!" I noticed he winced a little when I said that, I think he was bracing for a little tirade  . But, why shoot the messenger? Then I said well at least I know now (maybe lol). Then he says for me to expect 3 to 6 months processing time from my new NOA1 date which is 7/24/06! #######???!!! I said well since I know of people who filed in July that are approved now I will just hope that means ours is coming soon.

I wonder if that means that as far as USCIS is concerned we haven't even submitted our application :P

I'll be glad to send another one, but this time to Speedy Vermont :) and we wouldn't even need a waiver for the 2nd I129F! :D

Aren't they something?

Dean, I'm really sorry you've had to go through this. The latest update when I log on says...

Application Type: I129F, PETITION FOR FIANCE(E)

Current Status:

On September 28, 2006, we received your response to our request for evidence or information. However because preliminary processing was complete, the remaining processing time will be less than the maximum stated in this message. You will receive a written decision on this case. You can use our processing dates to estimate when this case will be done. Follow the the link below for current processing dates.

Check you status online and see if it says the same thing. If you're running into this wall with them, I'd recommend you get your Senator involved because it's bogus that they have you waiting while they keep approving later petitions.

Good luck.

Thanks. Oh and my status says the same thing which of course gave me some hope for awhile. But it is what it is. I hope for you and your girl that doesn't mean your new NOA1 date is 9/28/06. A really nice lady at my senators office said she would do an inquiry on my case couple of weeks ago. It will be interesting to see what they tell her. I'll post again when I get her response.

When you read the USCIS current processing times it warns you that in they have to send out an RFE then your clock starts again with the RFE receipt date.

But obviously this hasn't been case for most people here. He must have been talking worst case scenario. I wouldn't want to get your hopes up but I wouldn't give too much attention to what he told you either.

I understand your agony - I'm still not approved 200 days and counting!!

Good luck :)

Yeah, it might make sense if it was the petitioners screw up that caused the RFE, but this is their screw up and stupid RFE. I did also tell him that I knew of people that had been waiting since March amd still no approval. Good luck to you too!

Un-f%$@ing-believable!!! Didn't USCIS announce just in the last month or so that they are now NO LONGER using RFE dates as NOA1 dates? Once again, USCIS proves that they can do whatever the hell they want whenever it happens to be convenient for THEM!!! You handled yourself incredibly well at that office today. I think I would have just broken down in tears. May your NOA2 be VERY quick to arrive. If anyone deserves to be on the "Should be approved for good behavior and positive attitude ALONE!" list, it would be you...

I know I would have just snapped at that response. I gotta believe it was a 'buy time' answer. I wouldn't go by what they said, but instead just hope and pray each day. Sorry.
