URGENT: accidentally opened visa envelope

Howdy...

We passed our interview (yay!) and the visa was delivered today. However, my wife misunderstood the instructions for not opening the envelope. She received a clear envelope that contained both her passport and another clear envelope that had the brown folder. She opened the clear envelope to get the passport, then thought that she could also open the clear envelope around the brown folder. She thought the brown folder itself just needed to stay sealed. Apparently, the brown folder is open on the top, and this clear envelope was the one that she wasn't supposed to open. :cry:

Needless to say, we're both very very concerned about this, including the big warning that says opening it might delay her POE. What do we do now? Can we go back to the embassy and get it reissued? Can we just go to the POE and explain the confusion and what happened? Like everyone here, we've done quite a bit to try to get things done (right) and we don't want it all to blow up at the last moment. :( Thanks for any help you can give us. ttyl,

I told my wife about 5 times not to open that darn thing :) My opinion would be to go back to the embassy. Just my opinion. If you're in a hurry, wander over to Mag-Anak yahoo group and ask Ray.

This had to happen before plenty of times, but is not really an embassy specific issue (except for what they do when you go over there). I would not risk reaching POE with an open envelope, because all bets would be off, and if you got a negative officer (which there are plenty of), they could confiscate the envelope, refuse entry and send her back, and then you would have to do everything all over again. I agree with the last poster that you should go back to the embassy and take it from there. Good luck!

Well, the trick that caught her was that we'd heard over and over that there's a brown envelope that you're not supposed to open. We hadn't read anything about the clear plastic that was around the brown envelope (maybe we didn't read enough). So yeah... tell her not to open *that* one. ;)

We're thinking that we'll need to go to the embassy too, just weren't too sure if there was anything that they'd actually do. I'm also going to call the cbp for her POE in the morning and ask them what they think about it and if she's really going to have a difficult time with having opened the folder. Thanks Joel. ttyl,

I would certainly agree with japau, Go back to the embassy and try to get it re-issued.. cuz that might be the only way.. if you get refused at POE then its a big big hassle.. best of luck..

Here's where we are now. My wife called the USE and they told her to go there and report to Window X. She'll do that first thing tomorrow morning since it's already fairly late in the afternoon there. Thanks everyone for your help. I hope they can just reseal it and call it a day.

Regarding what's in the envelope, she didn't look through the whole thing, just noticed some of the paperwork since it's open at the top. She said that what she did notice was our DS forms (the 156 and 157, I assume), the copies of my taxes that I gave them with the I-134, and my paystubs from work. I would venture that the I-134 is in there too.

Wish us luck! I'll keep this thread posted with what we discover from the embassy. ttyl,

My lovely wife opened her K1 brown package that she's not supposed to open. Embassy sealed it back up the next day no questions asked. The officer who helped her said it happens all the time and that she would most likely be refused entry at the POE if she had gone with it open.

Luckily my wife lives 20 miles from the embassy so it was easy to go back.

Hey Mich......off the topic question for you?....Didi you file an I-130 and I-129 petition? I just didn't see it in your timeline? I hope my process goes at least as fast as yours if not fater! My wife is 12 weeks pregnant and I'd like to get her here before she has our baby! Thanks for any input you might be a ble to share!

Mich, congratulations to you, both for the Visa. I am sure the Embassy will seal it. Don't worry.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

My wife is 12 weeks pregnant and I'd like to get her here before she has our baby! Thanks for any input you might be a ble to share!

His compleat time line is in his profile. It looks like about 10 months from start to finish....longer than the time it take to have a baby.

As mentioned in previous replies to you, don't worry so much about where your baby is born. He/She/They can still be entitled to US citizenship. I doubt that your wife will get the visa in time, or if she does it will be too far into your wife's pregnacy to travel and or find a OB/GYN in the US.

I have heard that after 6 months, if the person is not already insured it is concidered to be a pre-exisiting condition and not covered by private insurence. I can't be listed on my husbands insurence plan until I receive my SSN which I understand takes about 3 months from the time I enter the US with a K-3.

I'm currently 11+weeks pregnate myself and am in Canada while my husband is in the US, so I understand the disire to be with your spouse durning her pregnacy. Just continue to be supportive and remember the dates of all her Dr. visits so you can follow up and ask her how they went. My husband also sends a message to the baby every night, so after he/she is born they can see how much daddy loved them and was involved with the pregnacy. Mybe you should try it :)

01-04-2008 | Interview In Montreal. VISA GRANTED
01-11-2008 | Arrival in the US
11-09-2009 | Biometrics taken for 10 year green card
01-20-2010 | Approved- 10 GC ordered for production

06-22-2013 | N-400 package sent
