Hi everyone: just have a question im trying to help someone and they asked me they are married newly weds and they feel that the K-3 process is taking so long and they were told if they get divorced the can reapply for the K-1 which they were told is much faster im not sure what to say to them any feedback that could help me explain more to them would be appreciated they are now waiting for the NOA 2 for the I-130 which i believe will come soon I'm at a loss of what to say to them

Sorry, I don't mean to be rude. But that is just about the most retarded thing I've heard in quite awhile. I mean I could go on and on but I've got to stop my self. I just don't have the time to go in to detail here. I'm sure someone else will though.

4-26-06 I-129F mailed

9-25-06 Interview: APPROVED!

10-16-06 Flt to US, POE Detroit

11-5-06 Married

7-2-07 Green card received

9-12-08 Filed for divorce

12-5-08 Court hearing - divorce final

That must be the most crazy idea I have read! :no:

Very bad advise, many questions will be asked about why the divorce, Then remarry? Also K1 and K3 both take about the same length of time so if refile then the length of wait will just be that much longer. The K1 petition probably will get rejected at the USCIS service center.

Once a course is started it is best to stick to it.

When the dust of the replies to this post settles, either print out the posts for them to read, or just simply send them a link to it!

12/30/2008: Overnighted I-751 package to VSC

01/06/2009: Check cashed

01/06/2009: NOA (arrived 01/09/09)

01/23/2009: Biometrics appt letter received

01/31/2009: Biometrics scheduled

05/20/2009: APPROVED

06/23/2009: 10 Year Green Card arrived

Well you will have to provide info about all past marriages in the I-129F. And when you provide name of the same person as your ex-spouse and current fiance(e) ............................................They are very good at balancing the other side of the equation.

Please don't do it. The real concern u have is approval at USCIS. Well did u know that some K1s have taken longer than K3s?

That and...Chances are, memorialising a divorce overseas will take longer than if both parties were in the USA. Where are the parties, anyway? Is this a particularly slow consular region that they suspect they're not in the homestretch? Why would an additional K submission move along at any faster pace? My understanding is that you're friends are already well into the process. Why start over? More fees, more uncertainty. It's certainly a circuitous route to just about the same place. in my estimation.

I agree with most of what you wrote, with the exception of the piece about location and potential delay. We are talking about breaking a matrimonial bond, for convenience. unforgivable in my book.

If the relationship is good, why would anyone in their right mind divorce for visa benefits? Patience is a virtue!

That and...Chances are, memorialising a divorce overseas will take longer than if both parties were in the USA. Where are the parties, anyway? Ok, lessee, you have been waiting this long for the K-3...and you want to start all over to get a K-1, not to mention look really goofy in front of the consular at the K-1 interview? :bonk: I would rethink that....ALOT!!

Just be patient, and even if the K-1 is that much faster, you already lost all that time in the waiting you have already done.
