Timeline

Can we start a new thread ONLY for those of us requesting an IMBRA WAIVER? I requested a waiver at the time I returned my RFE (July 6). My WAIVER request is because I have filed two previous K1 visas in the past sixteen years.

I am so anxious to know how the USCIS will deal with these waiver requests and what criteria they will use for approving or denying them, as well as the time they will take to adjudicate them. I know there are a few of us in the same boat.

I am sure all of us will get through the RFE and IMBRA basic requirement fine. It is those of us requiring a waiver that really affects and concerns me.

I have had no touch since the USCIS acknowledged receipt on the 13th of July. Email received 14th.

03/28/2006 - NOA 1 (Receipt) - NOA issued from CSC

07/03/2006 - RFE (Receipt) - RFE Received

07/07/2006 - RFE and Waiver Request - RFE arrived at CSC

09/01/2006 - NOA2 - USCIS Email - Approved w/Waiver

09/22/2006 - Electronic Version - Manila - Embassy Received

12/13/2006 - Packet 4 Received via DHL

12/21/2007 - Medical St. Lukes

12/22/2006 - St. Luke's canceled medical in progress - required additional tests in Jan for upper respiratory congestion.

12/28/2006 - Interview Canceled because of congestion and cough during medical at St. Lukes

01/09/2007 - St. Luke's for 3 consecutive days of "sputum tests and finish medical"

01/10/2007 - St. Luke's for 3 consecutive days of "sputum tests and finish medical"

01/11/2007 - St. Luke's for 3 consecutive days of "sputum tests and finish medical"

01/12/2007 - St. Luke's for pulmonary exam - EVERYTHING CLEAR

Yea, I have questioned that also. I am with you on that multiple petition waiver, but I know there are a few others. My only comfort is so far, noone with a later RFE returned acknowledgement date has been approved. That will concern me.

6/01/06 - Redirected to CSC

6/14/06 - CSC e-mailed confirmation on the reciept of file

6/23/06 - They they sent the IMBRA RFE

7/03/06 - The emailed that the IMBRA RFE went out on 6/23/06

7/03/06 - I received IMBRA RFE

7/05/06 - Touched

7/06/06 - Delivery Confirmation from the Post Office RFE recieved

7/11/06 - Email notification from CSC that IMBRA RFE Recieved

7/12/06 - Touched (but was to respond to an email that only said 'request recieved and will be processed within 30 days. argh)

7/13/06 - Touched

NOA2 September 11!!!

10/18/06 - Received at Embassy

12/23/06 - Recieved package with interview/medical schedule

01/08/06 - CFO interview/(pre-departure class) Complete

I too had to request a waiver, but I think my situation is a little different than yours. We are petitioning for a K3 visa, and I had to ask for the waiver because we had previously had a K1 approved.

The bad news is we have no news yet.

The good news is the the beneficiary for both the previous K1 and now the K3 are the same, and maybe it won't be a big deal. Also, we can get around the IMBRA with the CR1 visa.

I haven't seen anyone else mention the waivers until you did today. Hopefully it won't slow you up.

I agree...But, I like the sound of it. At least we know we have another option if this turns into a mess. Lets try to look at the optimistic side. I find this good news. Something I will research before doing, but definately a consideration if it becomes necessary.

Waivers - putting in a letter was all I did, but mine was for multiple petitions. With convictions, I think you also will need documentation like court records or something. I don't know what the convictions were for, not really my business. Noone here knows how they will affect you later. We are all the first batch to deal with this process. There isnt a form (so far) but that could possibly change later.

Option B - I don't know anything about it. This thread was the first time I heard that mentioned as a possible alternative. It's something I may have to look into if the waiver is a problem.

I think when you guys say "option B" you are referring to the CR-1 visa. This visa is for married couples.

Here's a little background. Of course you know the K1 is for fiances and it is filed on the 129-F form. When IMBRA went into effect we think it was to screw with people wanting a K1 visa. It turns out that people already married, after applying for a CR-1 visa, which supposedly takes a long time, can then apply for a K3 visa which allows the married couple to be together sooner. The K3 visa also has to be filed using the 129-F form and by default had to deal with IMBRA. As of right now, married people applying for a CR-1 visa do not have to deal with IMBRA.

No. But then again they didnt process mine till 7/11 even though they got it on the 6th. I am ASSUMING (I know that can be dangerous) that they just havent gotten that far in the stack after the injustice of organizing by RFE receipt date.

Those of us with Waiver Requests are all anxious to know what procedure they will follow and how strict they will be in honoring our waiver requests. Has any Waiver applicant even been touched since their waiver was received along with the standard IMBRA RFE?
