Hey can permanent resident apply for spouse Green Card

hey guys.......

I have friend , he has B1/B2 10 years visitor visa, he is here in usa, he met somebody here in usa and wants get married, but the problem is his girlfriend has green card, and 3 more years to get citizenship.

1.....so my question is if they get married,can her spouse apply for green card or work permit or not.......so he has to go back and wait for her ctizenship.

2....as she is RN nurse ,she got her green card on basis of direct nurse basis, she can apply for citizenship after 5 years, still 3 more years.

so what they have to do.......

An LPR can petition for a spouse - however it takes 5 years and the foreign spouse has no immigration rights in the intervening time. So your friend would have to go back to his home country and wait 5 years or until his wife becomes a US citizen.

They cna get married, but he cannot stay. He has to go back to his country, and then she can petition for him. Once she is a citizen, she can upgrade the petition.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
