Timeline

The saga ends with a denial.

After the "white paper," we've been working to get all the paperwork just right, waiting since September. Today my wife went to resubmit. They interviewed her and asked why I haven't come back since our wedding on Christmas of 2005. (I had been in graduate school, broke, had to get a job and then worked and had to vacation time to leave for Vietnam.)

We had every piece of paper you could imagine.

Anyway, they are sending the case back to the U.S. :dance:

It's been such a long road and we are beyond the point of sadness or sorrow, so it's not really an emotional thing anymore. It's now a lifestyle for us.

We'll figure a way to try again and start from the beginning.

Good luck to all of you who are on this torturous journey. I hope your luck is better than ours.

Wedding in Vietnam: 12/25/2005 (graduate school, below poverty line, couldn't apply)
[b]August 27, 2007[/b]: 1st I-130 packet sent w/incorrect $190 instead of new $355 fee (Mesquite, Texas).
October 6, 2007: 2nd I-130 packet with $355 fee (Mesquite, Texas).
January 10, 2008: NOA1 March 31, 2008: NOA2 (approved & sent to NVC)
April 14, 2008: NVC sent AOS Fee Bill (Affidavit of Support) $70.00 & DS-3032 form
Received.
April 15, 2008: Faxed wife the DS-3032 agent form to be mailed from Vietnam.
May 5, 2008: NVC sent request for Affidavit of Support form. May 19. 2008: received NVC's request for Affidavit of Support form.
May 20, 2008: Sent off I-864, Affidavit of Support May 30, 2008: Received IV Fee bill for $400 --money order & sent by Priority Mail.
June 10, 2008: I-864 approved. June 11, 2008: IV fee entered in system. June 16, 2008: DS-230 barcode issued
June 30, 2008: DS-230 mailed by expressed mail July 3, 2008: DS-230 package arrived at NVC & under review
July 11, 2008: Case completed at NVC.
Sept. 5th, 2008: INTERVIEW DATE at HCMC: White paper with writing.
March 26, 2009: Resubmit.
[b]DENIED. June 2009: case sent back & received at USCIS[/b]
August 2009: filed new I-130. Approved after first I-130 case sent to VN, again.
February 2010: USCIS contacted & asked for more evidence
March 2010: USCIS re-approved original case.
April 14, 2010: Consulate sends DS-230
June 15, 2010: Interview Date (Blue issued)
July 13, 2010 Placed on AP -yippee!
Sept. 13, 2010 Consulate home visit
[b]Nov. 5, 2010 Approval letter sent.[/b]
[b]Nov. 19, 2010 Visa picked up. Arrival: Nov. 24, 2010[/b]

You can resubmitt again, how many trips did you make total? I was denied for a simular reason our interview was in november of 2008 but they said I only made 1 trip and have not been back since december of 2007. If you make a second trip you can resubmitt because you have to have met within the last 2 years not sure if its the same with a CR1 though. I would take another trip hire a good attorny and file again. Don't give up on her if you love her you have to fight.

09-15-2009 : Writting test from DVM.

11-03-2009 : Driving Test.

04-26-2011 : Received I-797 NOA with Receipt Number

I flew out in december 07 and got a new job in april 08 so I didn't have vactaion time or money to fly again in november 08 so that was a big reason why they denied my visa. Once you have a new job and can take time off the results will be different this time around. Just show up at the interview and it shouldn't be a problem. I would contact your congressman or an attorny now to see if they can stop it from being sent back maybe if you take a trip they will interview you or reconsider

Hi Bryon,

My fiancee got denied on Monday too :crying: (we didn't have an engagement celebration yet i did clearly explain to them the reason: We postpone the celebration until my fiancee is granted the visa).

1/ Is it possible to stop it from being sent back for while before I fly over? Will they even let me in to present my case? If so, how do I make appointment at HCM Consulate?

2/

"The case will next be reviewed by the Immigran Visa Chief and will be returned to USCIS ....."

====> Will the Visa Chief actually review my case BEFORE sending back to USCIS?

Contact your congressman and an attoryn like Marcus Ellis before they send the case back. There is a chance you can stop it and get them to reverse it.

My fiancee wanted a big engagment party and I told her we would do a 10 table engagement party as soon as she got her visa but we also had a small one I could afford with 1 table when I went there on my first trip. They didn't mention anything about the engagment party in there denial so the small 1 table must have been sufficant to them. Since she didn't get her visa we decided to get married and I bought 20 tables at the wedding and skipped the big 10 table engagement party.

Did they list on your denial about not having an engaement party?

Ok... After 4 trips to Saigon, The consulate has stopped the dance for documents and has issued my wife a pink slip.

Informing her to return on the 31st of March to pick up Visa.

Has anybody been misled at this point? Is it another tease?

Man, Never say die!... only say this, I just need to vent a little before getting back into this BS game. I will never give in... never...never... never I fight mai mai... then one day, after feeling like a ping pong ball... all will be fine, because she is home... and after some time passes you will forget the details of the fight,... "You will never forget the fight," just the details and most paperwork associated with the process.

Stay strong, stay in the game until you die... if not, you never REALLY love this person. I started in 2004 She, (my then fiancee) touched U.S. soil on June 1, 2007 tomorrow evening she will begin her second journey to visit home. We are very happy together and very much in love.

I can say to you the truth... I would still be fighting to this day... will you?

How is married life treating you? I just got married myself on feburary 28th going back to pick up the marriege certificate april 10th. I hired M.E. I figured any attorny that can help get a K1 visa with just 1 trip is worth his weight in gold. I will keep in touch

Did they list on your denial about not having an engaement party?

Yes as you can see my posted scan. I'm thinking flying back with my father to show them I'm deadly serious to marry and overcome that denial reason. What do you recommend - contact ME/congressmen or fly back here next week w/ my father while the case is still at the Consulate? BTW, how long do they keep a case at the Consulate after a denial? Pls advise as soon as you can, i much appreciate it.

I got a visa after only one visit also. And some other stuff that I read that seems to be a no no too I did. Like being introduced by her Aunt. They actually paid for my trip there. ( It was as a way of thanks for some stuff I did for them though) Was married to a Korean girl and divorced many years ago. Got engaged quickly and never knew each other that long, etc. Also I never used a lawyer at all and did everything myself with the help of this site and advice from others here.
