Changing middle and last name after marraige

HI,

We were just married Nov 19th, 2008. in Wisconsin Can anyone tell me the process to change my wives name? She is from the Philippines and we want to change her middle name to her maiden name and now her last name will be mine. We were married by a court commissioner and told to go to the court house which we did today. The lady there wasnt sure of any answers and told us to go to the SS office.

Any comments?

as long as you have your marriage certificate she can use your surname in any legal documents. especially in applying her adjustment of status.

Right, But the question is about moving her maiden name to her middle name. Its the custom with Filipinos to replace the middle name with the maiden last name. Example:

Maiden name Jane Doe Smith now she marries Mr. Johnson. So it would be Jane Smith Johnson. Former middle name drops off and the maiden last name of Smith becomes the middle name.

Its not really an AOS question.

automatically her single last name will be her middle name now.... so, she can use it in any legal purpose especially in the AOS application. im not saying that u r in the AOS. i am saying u can use it ESPECIALLY in the AOS application. in the SSN application, the others have problems using their full married name. they are still using their single name. do u understand now? i am just giving u a hint.

Not sure but in the Philippines it was simply showing the marriage cert to the respective agencies and getting new IDs such as a new passport. Since your looking to do what is customary in the Philippines it may require her to get something like a new Philippines passport. You might want to the the Phlippines Consulate a call in Chicago if your from WS. the number is (312) 332-6458

We just took my wife maiden last name an put it as her middle name on AOS form

We did the the same...After we received our marriage certificate, we went to SSA, applied for SSN using my two first names, my middle name i changed it and my last name i used my husband's family name. I used my new set of names when I applied for and sign any documents including EAD, SSN, AOS, etc.

Example: (Unmarried Name) Ana Katrina Gonzales Barretto - changed to - Ana Katrina Barretto Bush.

Just present her passport, birthcertficate and marriage license if they want to ask for more Identification.

hello Bucksol,

what you do is have your wife's passoport ammended so she can bring your name then. All you need is send her passport to your nearest US embassy and file for passport ammendment..thats what i did. Hope i have helped.

I obtained my SSN before I got married so it was in my unmarried name. After I got married, I went back to change my name in the SS office but they wouldn't let me unless I have documentation from the immigration office, therefore I had to wait for my AOS approval.

I obtained my Driver's License but they wouldn't let me put it in my married name unless I have documentation from USCIS so I had to wait again for AOS approval.

All my identifications were in my unmarried name before AOS ( DL, passport, SSN)

Now that my AOS was approved I was "permitted" to change my IDs to my married name.

Needless to say, based on experience, all government transactions would need proof from the USCIS of the AOS before she can obtain identification cards using your name. However, in private transactions, she can already use your name. Our joint account and debit cards are already in my married name even before approval of my AOS.

If you really want her to use your married name before AOS, you can amend her passport in oen of the Philippine EMbassies here. However, the process would involve sending that passport to the embassy for processing and she will be left without any identification.

I suggest that she obtain her driver's license first, even if it will be in her unmarried name before you send her passport for amendment so she has a valid identification ( she will need this in case you two will travel via plane ) . This is what I did. When I had my learner's permit to drive, I immediately sent my passport for amendment to have my married name and at the same time I have my learner's permit as Identification because I travel with my husband a lot.

I did the exact same thing. On my marriage certificate in MA it allowed you to write what your name after marriage would be, and then when I went to Social Security, I just changed my middle name and last name on the form. It was very easy.

This is correct. Generally, all that is needed to change your last name is your marriage certificate, but some states consider using your maiden name as a middle name a legal name change requiring whatever procedures that requires while others will let you do it automatically. I do not know the answer for Wisconsin. You could also ask the county clerk's office where you got your marriage license and certificate.
