What if I751 wait is over 1 year?

Hi everyone,

I've tried to read all the info before asking questions, but after ogling the screen for hours I still couldn't find a very clear "procedure-like" answer to the question: What if the I751 wait is over one year?

As far as I know:

1. I can file for naturalization once the year is up, but this will not speed things up.

2. I should make an appointment with InfoPass to get a renewal stamp.

3. Renewal stamps may be for 1 yr, 6 mths, or even 2 mths.

But--

1. When should I make the appointment for the renewal stamp?

(How much time should I allow for them to process it?)

2. Which documents do I need to bring? Will my husband need to come, too?

1) This is literally a stamp in your passport, therefore there is no time involved to 'process' it - when you meet with the USCIS officer at your Infopass appointment he will place the stamp in your passport at that point and then give you your passport back... with the new stamp inside...

2) Your Passport, expired greencard, and whatever letters about your pending I751 you have from the USCIS (e.g. expired / expiring extension letter, print out from case status online etc etc) to help prove your i751 is in progress...

An infopass appointment is basically like a doctor's appointment - you wait till your number is called and then you talk to the officer and they will either do what you need right away e.g. extend your stay or tell you what you need to do to get it done. It can be as quick as 20 minutes or a few hours depending on the number of people ahead of you. Good Luck

Take a copy of this memo with you when you go on the INFOPASS so that you will get that 1-year stamp on your passport.

This is very helpful. Thanks OP for starting the topic. I am still confused about two things.

1. Do I have to wait till one year passes from my green card expiration day to make an infopass appointment? Can I do it a month or a few weeks before expiration?

2. If my passport is expired as mentioned above I can get an I-94 form with picture and 551 stamp. Can it be used as verification of employment?

On employment eligibility verification form I-9

will it serve as List C #7(page 4)?

Every local office seems to make its own rules, but I know of people at my own local office who have gone a few months BEFORE their one year extension letter expired, and they did get their stamp. My husband's letter expires towards the end of May, and he will try to get the stamp sometime in April.

I went in 9 days before the extension expired. Received an extension for 1 year from the date 1st extension was supposed to expire.

I think you need a valid passport. Mine had been renewed - so the original bio page showed the passport as having expired. The officer said "your passport is expired." So I had to show him the renewal, at which point he said "Oh! Good, it is valid enough to receive 12 months' extension" (or words to that effect).
