K3 No longer a valid visa!!!!!!

I just got off the phone with CSC to verify rumors I'd heard from other applicants, and it's true: K3 visas (the I-129F's) are no longer being processed. AND IN FACT WILL HURT YOUR CASE IF FILED IN CONJUNCTION WITH YOUR I-130!!!!

According to the CSC person I spoke to, as of late last year (no specific date was given), K3 visa applications (I-129Fs) are simply being grouped with their corresponding I-130 application. When the I-130 is processed, the I-129F is cancelled. This process of grouping and cancelling, delays your I-130!!! It was explained to me this way (although I don't know how accurate the info is): Your applications are taken out of the queue by an officer to be grouped, which causes them to be put back into the queue further back, since the queue continues to move forward while your application is absent (if that makes sense...).

I couldn't believe my ears when I heard that!! I'm a July filer and most July files are already processed from what I've seen here on the forum. Not me though, as well as several others of you. The representative told me today that it is probably because I filed the K3 (I-129F).

This is $%##$ing INSANE!!!!!!! I can't $%##$ing believe this!!!!

I don't know why they keep saying that. Both my I-130 and K-3 were approved at the same time on Jan. 9 and my K3 has been forwarded to the NVC along with several other peoples. In fact, VJ'r Chimeneze had his K3 approved on Jan. 15. His K3 was forwarded to the NVC on Jan. 23, and his petition is now in Nigeria where his wife picked up packets 3 and 4 and has an interview date of April 8 and also Ose-N-Me from Nigeria also has their K-3 in Nigeria and have interview dates and they were approved on the same day as Chimeneze, so whoever keeps saying that to people is not telling the truth. Sorry that you are so upset, but don't listen to it.

USCIS needs to get their act together,this is totally different than what most of us have been told.

but to be honest,i wouldn't trust too much what one says,since you can call up twice in one day,get two different officers and get two different answers to the same question.

I believe it'll be us late July filers and later filers that are going to be affected. (The ones with the I-129F fee waived). However there are SOME July filers that are getting both petitions through. My husband just called CSC and got the same answer that Firstenburg and Nita&Assad recieved. I can imagine my file sitting in the late August pile because of the I-129F...only to have it cancelled in the end. #######??!!!!!

Summer 2004: Met while on J1 visa; J1 internship was 3 months (subject to 2yr-HRR)

2004-2008: Visited US on B1 / Steve visited Nicaragua as well (living in different countries! while I fulfilled 2yr-HRR)

I'm surprised to be hearing this from you guys. This is a fact. My I-129F has been grouped with my I-130. I just called my congressman's office and the guy who works visa cases there, told that he has known this for some time. K3 visa's are not being processed on their own. And this was the 2nd USCIS rep I spoke to who told me that the I-129F will delay a visa....

In fact it is the other way around, if an I-129f is submitted for K-3, the USCIS will hold the I-130 and just send off the I-129F for K-3 visa, they do not send off the I-130 for CR-1.

What is going on with this people, I called today after one month was told they are starting to work on June I-130's - and she was so rude, I hung up the phone and said, what has happened......

Have taken a break from the site for a bit but after today, God, they are so messed up, this whole process is what 18 months long????? I could have given birth to two babies without this much pain.

I also want to chime in to remind everyone that the USCIS officially states that the correct filing procedure is to send the I-130 in and wait for the NOA1 (and transfer notice if you filed at the new Chicago lockbox per their updated filing location instructions). Once you have the NOA1 then you should file the I-129F at the Service Center the underlying I-130 is being processed at (as listed on the transfer notice / NOA1). I see many people filed them together to the lockbox but I am just citing what they say on the official USCIS instructions.

As soos as, my check is cashed I sent in I-129F to VSC with copy of a canceled check and I got the NOA1 for I-129F saying that Fee is waived etc... When I checked the case status online "Last Updated" date is keep changing. It had today's date when I checked it. I believe that means it is being touched?? I still don't have the NOA1 letter for I-130 though.

Both my I-130 and I-129F ..........are moving forward. I'm going to cancel my K3 now. I doubt they're going to hold my I-130 once it reach to NVC.
