Hi There,

I filed I-824 almost couple of months ago to send my approved I-130 to foreign consulate, when I checked the status of my I-130 petition, it says we APPROVED this case on APRIL 16, 2008 and sent you a mail notice. But my I-130 was already approved, Does this mean they processed it to send it to National Visa Center?

If yes, how long it will take to leave from NVC?

Thanks for any input.

Why did you file I-824? USCIS will automatically send approved I-130 to NVC for CR-1 and IR-1 visas without you sending I-824, UNLESS you sent an I-129F for a K-3 visa.

Note: When NVC receives the I-130, they will generate a VISA bill, and an I-864 request, they will not send the visa petition on to the consulate until the US citizen responds to these bills and other requests from NVC.

You will have to wait for I-824 approval, you may have to monitor the processing of the I-824 on USCIS.gov. I have seen a few do the I-824 and it seems to take 3 months or so for USCIS to process the I-824 and then move the approved I-130 on to NVC.

Here is what will happen when NVC receives the I-130: http://www.visajourney.com/examples/NVC_Pr...wchart_v1-2.pdf

Note, by the time NVC receives, processes and sends on the I-130, you will probably have the K-3 visa.

The decision to go CR-1 OR K-3 needs to be made BEFORE sending the I-129F. If you want to go CR-1, then don't send the I-129F.
