What is the typical lawyer fees for filing a K-1 Visa. I was quoted over $3000 and that is not including any of the regular fees (application fee, work permit, etc...). I am a Canadian citizen looking to move to the USA to be with my fiance. The price seems steep just to fill out some papers and prepare us for the interview.

Also, once you are married there is a 2 year period that you must stay together in order to keep your residency, correct? During this 2 year period am I allowed to leave the USA at all (like on vacation)?

That is way too much!!! The basic fees I was quoted are generally around 1500-2,000 at most for a really good attorney. I can refer you to an attorney that specializes in the fiancé visas. She seems to be doing well for me. I’M doing a spousal visa petition. It does not matter where the attorney is or what state. They all do the paperwork the same. This attorney’s name is Deborah Webber. She is a Immigration attorney on is also registered with the immigration lawyers association. Here is her contact information and web sire. Canada is one of her specialties as well. I spent many weeks and hours looking for and attorney and even got hosed from th4e first attorney I hired. I fired him and found Deborah Webber. Tell Shane referred you. I paid 1400.00 for my case.

Unless your case will be difficult, (divorces, children, criminal record) you really don't need a lawyer. All I did was follow the guides on this website and had no problems at all. I guess I saved $3,000.

What's exactly is this fees for ?

1. Filing I-129F petition

2. Filing AOS+AP+EAD

Does it include items 1 & 2 or just for the petition ?

We didn't use a lawyer. The process is pretty simple if you follow the guides on this site.

17th March 2010 - Started the removal of conditions process

22nd March 2010 - Application received by CSC

30th April 2010 - Biometrics appointment

DIY!!! Save the money for the processing fees. The attorney is only going to gather your personal information and transfer it to the proper forms. It is so easy to do if you follow the steps here on VJ! If I can do it, anyone can.

I also went the cheap-o route; and I have no complaints. The great thing about the cheap-o route is if you need a lawyer along the way, all you have to do is go out and pay for one!

My friend did it for me and she's a whiz. If you want her phone number let me know. i know she can help you fill out the information for a small fee. She did our paper work and not 1 mistake. Interview is in 3 weeks, yahoooo

At this stage it is strictly a clerical job....i.e. filling out a couple of forms, and sending them to the correct address.

If with an attorney, you will still do all the work...gather the required papers and proofs and write a brief paragraph on how you met....you need an attorney for this????? Hire a secretary.

If you have a legal issue...pay and go talk to one, but use one to fill out a few simple forms???...never!!

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

REALLY, there is no reason to hire an attorney to file for a K-1. The process is straight forward and not complicated. Follow the instructions and seek advice here should you come up with something unsual or confusing.

Stop feeding the lawyers, they'll only continue to breed out of control. :lol:

Nov 2nd 2006 met online

June 28th 2007 sent 1-129f to NSC

July 11th 2007 NOA-1 received date on NOA-1 (now at CSC)

July 19th 2007 NAO 1 Reciept date on NOA-1

Thank you for all the replies. I looked up the K-1 guide and it doesn't seem too difficult but I would like a lawyer just to make sure I don't mess things up that lead to long delays. But, I do think it is too much to pay someone over $3000 to lick stamps and proof-read. As far as some of your questions go:

journeyman - I am not sure what the fee includes, I think it is just help throughout the whole process. I know the fee does not include any additional fees like the application fee or ANY fee for that matter. It is just the lawyer to take time to help out which is why it seems too expensive.

Kil - We both have no criminal record or children or health problems. We are both in our mid 20's. I am self employed and a Canadian citizen and she is a US citizen going to grad school in Texas.

The more I look over the guide the more it seems crazy to pay much for a lawyer. Kind of like paying a lawyer to help you fill out your application for a passport.

How long does the K-1 Visa process take from sending in the petition to getting the green card? I was told it could take from 6 to 8 months. If it was to take that long would I be able to go to the USA on a visitors VISA in that period of waiting for my greencard?

Also, I am still unclear about what happens after we are married and that 2 years in the USA thing. It means I have to live in the USA for 2 year after marriage? But I can leave for vacation right?
