Hi there,

 

My spouse is a US Citizen and I am a Canadian citizen. We got our DQ June 12 at NVC still waiting on the IL for Montreal Consulate, any ideas how long it will take? 
 

One additional question, NVC mentions I cannot travel, sell property, leave my job etc. etc. 

 

Is there any way I can travel into the States as a Canadian citizen visitor while I wait for my IL? Is there any legal way without it impacting my case? I.e. any application? Parole request form? Etc etc? I would like to know if there’s a legal way without the risk of my application being denied.

Logically CBP would not deny entry given you are close to getting an immigration visa. There is always a low risk of the worst case scenario: denial of entry, expedited removal, and 5 year ban. However if you are flying from Canada via a pre-clearance airport, expedited removal is impossible, so can reduce the 5 year ban risk to zero.

I believe the wording in the NVC letter is “ should not” referring to actions like booking your trip to immigrate, resigning from your job so you can immigrate, selling your house so you can immigrate.. they are saying that you should not assume your visa will be granted.. wait until you have it in hand before making all your immigration arrangements

 

The statement does not relate to your question about traveling as a visitor  .

The NVC wording regards actions involved in immigrating until visa is in hand.  You are not restricted from visiting the US during this process.  

"The US immigration process requires a great deal of knowledge, planning, time, patience, and a significant amount of money.  It is quite a journey!"

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Yes.  It means do not make travel arrangements to immigrate to the US.

You might not receive your immigrant visa after the interview. 

NVC is suggesting you don't/ warning you to not make any immigration plans prior to receiving visa. 

If you read this post you'll see some Canadians wait 6 weeks to a year after interview before they are able to move to the US. 

They are still allowed to travel (to the US and other countries) while waiting for the immigrant visa. They just are not able to immigrate yet. Therefore quitting your job, selling your home and cars is not recommended.
