Ok I dont really want to go back to the old topic that got everyone fired up :devil: But I do have a problem.

I put all the AOS documents in a manila envelope. I sealed it and all, then went to the local UPS store. I dont know why, but instead of mailing it out like that, I bought a plastic envelope mailer. So I put the manila envelope inside this plastic envelope. The manila envelope has our names and address, and the chicago adress on it as well. However the UPS sticker is on the plastic envelope. I'm guessing whoever receives the package will just open it up and toss the plastic envelope and hold on to the manila one. The problem is, the plastic envelope is the one that has the UPS postmark sticker with the date/tracking info on it. The manila would have nothing. Are they silly enough to charge me the increase prices if this happens?????

I don't know, but I think you'll be okay; they're not going to just open it partway and not note the date any more than they'd normally rip open an envelope without a date. My entire package is an envelope-inside-an-envelope.

In any case, there's little you can do about it now. Just breathe. :)

lucho, if they do something like that - which I don't believe they will - they are gonna send the whole package back to you.

In which case, I would go ahead and file the Advance Parole petition, cause you'll be paying for it anyway.

I'd like to interject here, if I may. I know you all didn't want to pay the higher fee, but the new AOS package really isn't the worst business deal I've ever seen. It does include EAD and AP - and it includes renewals of them for the life of your adjustment process.

God forbid any of you have an extended process (like we did - 17 months). We had to renew my husbands EAD one time - I know of several members here who have renewed EAD's multiple times. By the time we paid the original fees for AOS, EAD, AP, biometrics and one EAD renewal, we had invested as much as the new, higher fee.

USCIS is going to charge EAD renewals at the new higher rate. That means EVERYONE who filed prior to July 30, 2007 will have to pay the whooping $300 plus bucks to keep working legally. And believe me, they don't care if your process is extended because of clerical error on their part, namecheck delay, or whatever. I think that's patently unfair but that's the way they are doing it.

I'm hopeful the new fees will HELP with namecheck delays and that the adjustment process will continue to pick up speed. (If you think AOS is slow now, you should have seen it as late as 3 years ago - things are greatly improved now.) In congressional testimony prior to the fee increase, USCIS maintained a large portion of the new fees were to be spent on security checks, followed by technology advancements.

Since security is supposed to be THE NUMBER ONE MANDATE of the Department of Homeland Security, I don't see how they can spend the money on anything else first and justify it to the American public. Or to Congress.

That was pretty much my logic for not sending off the packet sans marriage license. God forbid we get a name hit, but if we do, we're better off with all the EADs paid for.

Not sure if you are one still updating July AOS filers or not, if so here is our info if not sorry for bother. :innocent:

We filed(mailed) I-485 AOS 3:57 pm July 27 and AOS application was received in Chicago at 1:37 am July 29, 2007. :D

The paperwork supporting these forms/applications is unreal, just like K1, it took several full days just gathering everything, requesting, copies made, then putting it all together in folder to mail. Had to be over 100 pages of stuff in there. :wacko:

Had heard rumor that this was all supposed to go electronic and online in future soon, I just wonder if anyone knows or has heard this also. :o

09-04-2007 - AOS Rejected - improper fee, even though it was postmarked before the 30th

09-05-2007 - Sent back entire package with new cover letter explaining improper rejection

09-23-2007 - AOS package rejected again! E-mailed Congressman

10-05-2007 - Went to Congressman's office - left packet there so be re-sent

10-19-2007 - NOA1 Received -FINALLY! Not rejected! :D

The bad thing thing is that I am expecting 2 RFE's for my package.

One for the vaccination supplement and the other for the marriage certificate. I will be expecting a 2 to 3 week delay in the process because of the RFE's, but I think it's worth it to save the $ on the filing fees.

I was only able to get a "copy" and not a "certified copy" for the marriage certificate. Lets see how this goes.

You might get lucky on the vaccination supplement. I know of 2 cases where the applicant sent only her DS-3025 (showing that she needed the TD vaccination) and received her green card with no RFE.

I also know of quite a few people who had only sent in the DS-3025 and got all the way to interview.... only to have pointed out to them that the interview letter tells you that unless you have already submitted the vaccination suppliment you will need to bring it with you to the interview.... they had not because thay thought they were safe having got that far.... they were given a RFE at the interview and were told a dissision will be made on your AOS once we have the information.... and so they left with no approval just a RFE and a rush to get the vaccination suppliment done and sent in....

Good info, Kez, thank you. We rushed to get the paperwork in and obviously didn't read enough. So we've got a little more work to do, and I see he might as well get the TB skin test while we're at it. I'll let our friend know as well.
