I sent my AOS and EAD papers on July 20 they received my package on July 23rd still no NOA 1 I assume it won't be until Aug.

Does this mean I am a july filler or Aug filler?

My cheap skate ####### mailed ours in on the 27th via UPS ground. It will not get to Chicago until the 2nd of August. I will still be paying the old fee's since it is postmarked the 27th.

Hmm.. I don't mean to worry you lucho562, but I'm not sure if UPS date of shipment counts as being a "postmark" date. It's too late now and you'll just have to see if they accept your submission of the old fees or not, but I fear USCIS may not accept your UPS shipment date as an official "postmark" date. I could be wrong, and for your sake I hope I am.

I sure hope you are wrong. I know that USCIS has different addresses that they receive packages in Chicago. One for USPS and the other for all other couriers. This gives me some kind of hope that their shoudlnt be a problem. I should find out any day if they cashed the funds.

You'd assume that as the date is was 'posted' is on the shipping label for both UPS and Fedex it should be ok. So technically it's 'postmarked'. I shouldn't see why it woudn't be accepted as it was mailed before the 30th and if they have a separate mail box to accept packages that aren't mailed by the post office, these carriers should be recognised.

But I certainly am not pulling this out of my #######. There are many government agencies who do not accept shipment dates from any private carriers as postmarks, only the USPS. Even the very definition of postmark "an official postal marking on a piece of mail; specifically : a mark showing the post office and date of mailing" is quite specific about it being related to postal mail and not private carriers.

We'll see. I'll be glad to be wrong for lucho562's sake.

I wouldn't have thought it would be a problem. There are a few mail carriers here in the USA and I can't believe that USCIS will only take USPS mail that is dated pre July 30th and ignore all of the others.

If your envelope had a date/time stamp on it I can't see that there would be a problem.

I sent a packet in durring 2005 just as the fee increase happened it was mailed by UPS the day before the increase and it was accepted at the old fee and we never had any problems....

If USCIS were only going to accept mail dated by the USPS then they would have had to notified the public of that rule.... UPS give you a receipt and a delivery conformation all dated...

Since when have I said one couldn't send their shipments via FedEx or UPS to USCIS? Of course one can. But with regards to postmarks, that's another story. USCIS will accept the package, but whether they accept the shipment date of UPS as the postmark date, we'll just have to see.

Here is the exact concept I'm referring to for another matter. Whether USCIS applies this, I'm not certain. But this was what I was trying to warn the OP about:

The proposed amendment to Rule 25(a) provided that in order to file a brief using the mailbox rule, the brief must be mailed by first-class mail. The current rule requires a party to use "the most expeditious form of delivery by mail excepting special delivery," which, given the advent of express mail and other special services, is no longer a clear directive.

The commentators on the published rule objected to the requirement that the postmark indicate mailing on or before the filing date and to the failure to extend the mailbox rule to private overnight courier services.

The Committee unanimously decided that the rule should make the mailbox rule applicable to a brief sent by first-class mail or by other "equally reliable commercial carrier."

Having decided to extend the mailbox rule to private carriers, the postmark requirement either must be eliminated or extended to include the alternate carrier's record of receipt of the brief. The postmark requirement was eliminated by a vote of 5 to 4. In its place the Committee unanimously decided to require a certification by the filing party that "on or before the last day for filing" the brief "was mailed to the clerk by first-class mail, postage prepaid, or dispatched to the clerk by equally reliable commercial carrier."

Perhaps USCIS has rules in place to allow for private carriers' shipment date to be counted as postmark dates, but in the general sense, a deadline with a postmark date of such and such do not include shipment dates from private carriers.

You can crow all you want Rebeccjo but there are plenty of government agencies who do NOT accept private carriers with regards to postmark deadlines. One is allowed to use private carriers, but their shipment dates do NOT count when applied towards postmark deadlines.

This may not be the case with USCIS, but I was simply giving a caution to the OP.

Sir Lancelot - You are quoting a regulation from something, somewhere regarding the filing of COURT DOCUMENTS (it's always helpful to quote your source). The filing of pleadings is regulated in all Courts by State Law - or in the case of Federal Court, then Federal Law. Such rules are indeed stringent as they involve either notification of the involved parties, or Service of Process.

That hardly applies to a postmark date. You can't compare apples to oranges.

I don't have to stalk you. All I have to do is read the forums to find you. You're posting all over the place. I would think you might appreciate learning when you make an error - a gracious acknowledgment of having learned something lends to credibility.
