Hello,

do I need a photo of my spouse when I file my I130 online?

  1. You must submit two identical color passport-style photographs of yourself and your spouse (if he or she is in the United States) taken within 30 days of filing this petition. The photos must have a white to off-white background, be printed on thin paper with a glossy finish, and be unmounted and unretouched.

it says right here on 5-A-3 that the 2by2 photo of my spouse is not needed, but I just wanted to make sure. As in, she has never been to the US; thus, would be exempt by the document I just posted.

Thanks.

A passport style photo of the foreign spouse is not needed at the petition filing stage, but one of you, the petitioner, IS required.

You did read the answers already given. Right?  Same answer for everybody in the same circumstances.  Yes, really!  Yes, I'm sure!
