Husband wants to withdraw application

Timeline

I finally left home for the shelter now for 3 weeks    To get away from my verbally and emotionally abusive husband. We tried marriage counseling and I’ve been in individual therapy for almost 3 months now because I developed anxiety and panic attacks. Yesterday I told him I’m getting a divorce and today he’s accusing me of fraud . He said he called immigration and they said he can withdraw his petition. I already have 2 years green card . What will happen now ?

You can file for ROC with a divorce waiver. Hopefully you have all your documents. Dont delay filing .. 90 days before your 2 yr card expires

As a follow up to this, if your divorce is finalized before the 90 day window opens, you can immediately file with a divorce waiver + copy of the divorce decree. 

 

If the divorce is NOT final before the 90 day window, wait until you are eligible to file and include the divorce waiver, then you can provide the divorce decree later once you have it.
