OPT F1 visa holder to Green Card

Hello, 

My wife and I got married on May 1st of 2022, My wife is an American citizen, and I am a OPT F1 visa holder. We are looking into applying for the permanent residency for me. My OPT expires February 7th of 2023. My concerns and questions are: 

1. What is the process? What forms do we file? 

2. Who files what form? 

3. What documents needed by each partner? 

4. How much would it cost? 

5. Is a  Lawyer needed? 

6. Husband has an USCIS account when applied for OPT, Is a new account needed? 

7. Any helpful resource beside this forum? 

8. Things to avoid? 

9. Any Tips?

This is a DIY site so unless your case is particularly difficult, you should not need a lawyer if you educate yourself, read the guides/instructions, and ask questions here.

April 29, 2013 - NOA1 for petition received

September 10, 2013 Interview - decision could not be made.

April 15, 2014 APPROVED. Wait for oath ceremony

Waited...

September 29, 2015 - sent letter to senator.

October 16, 2015 - US Citizen

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

1. Prepare paper packet for a concurrent adjustment filing ( I-130/I-130 A/ I-485/I-765/I-131/I-864 and I-693 medical) 

2. Packet gets mailed together, who signs what is explained on forms ( USC spouse signs I-130/ I-864, alien applicant signs rest) 

3.USC spouse ( birth certificate or Naturalization) , alien spouse birth certificate, passport w most recent entry , marriage certificate ( prior divorces if any for both) , passport photos for both, some evidence of living together since marriage 

4. $1,760 filing fee

5. If you can manage the forms , have no criminal issues and will keep up your research on the process, you should be fine DIY 

6.No , he provides that account on paper forms and info will update to his account, but note I recommended paper filing 

7. USCIS website and Google ( LOL) 

8. Avoid stress and overthinking , you will get an RFE if you missed something and can easily deal with it

9. Keep a complete copy of your filing
