We are having difficulties with the civil document submission process for my parents-in-law . Basically, and due to the fact that gov. offices in their country continue to be closed due to Covid, we are about 5+months after approval of their I-130 but still have not been able to submit/get all of their civil documents. I cannot find information on the website/submission portal about how long we have to submit these.

 

Our lawyer told us that we have a year from the notice telling us that a visa is available to them (I think he means the I-130 approval?) to get their interviews scheduled. Does that mean that there is not a deadline for the intermediary NVC steps before the interview?  Everything else other than the civil documents (I864, 260) have been submitted, but they will not look at these until the civil documents are submitted as well.

 
I cannot find information on whether there is a deadline for submission of the civil documents--my guess is that there isn't and that the deadline is to get this all done in time for the interview to be scheduled within the year? If anyone knows more, we would very much appreciate thoughts/information!

You must stay in contact with NVC to prevent your case from expiring.  That means at least once a year.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It started when NVC received your case.

Clock starts when NVC receives the approved I-130.  They may send a courtesy email a month or two before the 1 year anniversary if there has been no activity.  In order to keep the petition active you just have to send an email to NVC stating that you want the case to remain active.

 

 

Your lawyer should know this.  Maybe they meant to say this but didn't communicate it properly.

Thanks! Ok, so December then--we should have things done well before then (hopefully in the next month or so).
