Hi community, 

 

I need some guidance. 

I'm a greencard holder. My green card will expire on 2023. 

 

2 years ago I applied for a permit of reentry because I had to do a project for a non profit outside of the US. 

 

The pandemic happened, my permit of reentry expired on Nov 2021 and I'm still outside of the United states. 

I'm taking care of a family member who has been very sick. I'm realistically speaking I will be able to come back to the states around august 2022

 

I will stay for 3 months and then I will have to come back again to keep the project with the non profit. 

 

My questions are: 

 

1. will I have issues by reentering the country with  my green card and my expired permit of reentry? 

2. Will I be able to apply for another permit of reentry during those 3 months that I will be there?

I would head back now, no timeline, do you have a 10 year GC, dates do not seem to match with prior posts.

OK, I am confused, you wrote in late 2021 that you had not received your GC yet after applying in 2019 and having an interview in September 2020.  Now you are saying you applied for a re-entry permit over two years ago and have been outside of the US for over two years.

 

Can you clarify the dates?

Maybe.  The LPR discuss in, 


stayed out 9 years and had no problem re-entering.  
 

OTOH, this is current CBP policy:

If CBP thinks you abandoned status, and if you want to stay in the USA as an LPR don’t sign  an I-407.

Yes.  Don’t leave the USA until the application gets to USCIS.

Another day, another poster changing their story.  

 

3 months ago, he is waiting for his green card after adjusting status.  Now, he has an expired Re-Entry Permit.  Wow.  

 

One poster went from IR2 to F2a.  First, the petitioner is a USC.  Then, the petitioner is an LPR.  You can't go from USC petitioner to LPR petitioner.

Hey guys, 

I apologize, the old topic about the green card it was for a friend, he used my account to ask the community. 

I should have known that it will stay in my timeline, so I understand the confusion. 

 

MY Situation is that I got a 10 year GC on 2013, which expires on 2023

 

In 2019 I applied for a permit of reentry because I had to do research with a non profit in Ecuador. 

I went back to the states july 2021 for a couple of months and I entered with my permit of reentry. 

I've been outside of the states ever since and because I'm dealing with a family emergency I cannot come before Augusto this year. 

My permit of reentry expired oct 2021. I still have my valid GC. 

My question is, can I enter with my GC? what type of problems could I be facing?

Read what I posted earlier.  The answers haven't changed.  

 

Getting on a plane would be the problem you will face.  

 

You are choosing to stay outside the US beyond the expiration of your Re-Entry Permit.  You can try to come to the US before August.  You are choosing not to come before then.
