IR-1 instead of CR-1 on Green Card

We need your help and advice.

We registered our marriage oversees on December 15, 2019.

Husband Filed I-130 in US on March 19, 2020. Interview took place on October 23, 2021, US Embassy in Europe. Received CR-1 visa because at the time of interview Marriage was less two years. Flew to USA on December 29, 2021.

At the ATL Airport, Point of Entry Passport Stamp clearly shows date December 29, 2021, and is more than two (2) years of marriage. Why USCIS sent green card by mail as CR-1 but not IR-1?

How to correct it?

Exactly.  This happens.  That's how you get it corrected.

Who should file I-90, petitioner (husband) or GC holder (spouse).

I-90 asks to choose reason. What reason I should choose filling I-90?

The beneficiary as it is their GC

As already stated… Dept of Homeland Security error…   2d

As you must send the incorrect card with the application, make sure you have a saved photo or scan of both sides of the card for your files

Then online filling is not possible?

You file it online, choose the correct reason. Make sure you select your status as Lawful Perm Resident so it takes to you the applicable section.

Later down the road, uscis willl ask you to mail your GC. Till then use GC for any purpose.

Does it apply to CR-2 as she is 15 years old and came to the US on the same date as my spouse, which is her mother too?

Yes, of course.  Same procedure.  Frankly, I would file by mail instead of online and send the cards in with the form.

I was debating with myself: I-90 online vs I-90 paper version.

If we choose I-90 to file by mail, then we must send existing Green Cards along with I-90. Sending original Green Cards by mail to lockbox present a challenge since we need it in the nearest future (apply for driver permit, state ID, travel etc.) Consider processing timeframe for I-90 6-14 month it presents a challenge for us.

Not sure how online version of I-90 works as far as returning original Green Cards. Any thoughts?

Also, paper version of I-90 contains an explanation note at the end of application. I think it is very important to explain and provide supporting documents to demonstrate that government made an error. Didn't see it in online version of I-90 or maybe I miss it. Let us know your ideas about it.

Thanks so much everyone for your help.

My advice is to file by mail.  If you need to present the green cards for other reasons, get it done before you file the I-90.

What evidence should I present when filing I-90? CBR officer stamped spouse passport as CR-1 for my spouse and CR-2 for stepdaughter at the date of enter US (12/29/2021).

Two (2) year anniversary was 12/15/2021.

The evidence is the combination of the visa stamps, and your marriage certificate.
