Affidavit of support. Need help !

Hi guys,

 

so on January 3th my husband filled out and signed form i 864. 
 

for the three most recent tax years, he put the years 2021, 2020 and 2019. 
 

is this correct, or should we start with 2020 as the most recent tax year ? In his case it doesn’t make a big difference income wise because he did not have any income in 2021 and 2020 and we have a joint sponsor to help out. 
 

Our joint sponsor has also already filled out the form with 2021, 2020 and 2019 named as the most recent tax years. We are now waiting for her to file 2021 taxes in February (she already has a W-2 for 2021) and then attach the new tax transcript from 2021 along with the ones from 2020 and 2019. 
 

is this the correct way to go about it or should my husband and the joint sponsor put 2020, 2019 and 2018 as the most recent tax years ? 
 

We are unsure because it’s January and we don’t know if the NVC will accept 2021 as the most recent tax year yet.

Most recent years are 2020, 2019, 2018..Waiting for IRS transcript for 2021 will cause a delay. During peak of COVID, those transcripts were taking forever to show up. 

 

So, ill suggest both revise their I-864 and use 2020, 2019 and 2018. They're the most recent IRS Transcripts available 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

We will revise the forms and use 2020,2019 and 2018. 
 

Also, for question number 7. “My current individual annual income is:” do we just write down the adjusted gross income OF THE MOST RECENT tax return (which is the 2020 tax return) or how to we go about that ?

Yes. 2020. And just FYI, this is solely for the petitioner, not he immigrant/ beneficiary. If you do not work, they should be 0.

Make sure you are not confused.  The 2021 tax return is filed in 2022.  It would be rare to have already filed the 2021 tax return.  

 

Current income for an employed person does NOT come from a tax return.  If employed, take the gross income from a full recent pay period and multiply it by the number of pay periods in a year.  Weekly X 56, Every two weeks X 26, twice a month X 24, monthly X 12 etc.  If a person is not employed today and has no income, enter $0.00 regardless of how much they made in 2021.

 

For information from tax returns use the Total Income line, not the Adjusted.  (Sometimes those are the same number.)  When reading instructions, pay attention to the little words like and, if and or.  Adjusted gross is only applicable if the 1040EZ form is used to file.

 

Facts are cheap...knowing how to use them is precious...

So you agree to use 2020 as the most recent tax year right now, correct ? 

The explanation about how to calculate current income was extremely helpful. Thank you very much. What about bonuses ? Our joint sponsor probably meets the requirements even without her bonuses but how do we calculate those in ?  Also we were planning to attach recent pay stubs, would that be sufficient enough ? 
 

My final question is: Could the fact that my husband did not have any income the past 2 years and therefore was not required to file income taxes cause problems and/or lead to a denial ? 
Anyone here who’s been in the same situation ?

The 2020 tax return filed in 2021 showing 2020 income is currently the most recent tax return

One recent pay stub is fine as evidence of current income.

No worries regarding bonuses.  As long as the income stated is comfortably over the required amount, it's fine.  They can see the past income is actually MORE than the stated income.  It's not a problem.

Not required to file a tax return is not a problem. Being required to and not filing is a problem.

 

Lots of members here have been in the same situation but may not be reading and replying.  More important is to get the right answers from somebody who actually knows. 😉

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
