Feeling stuck. Long Distance Struggles... Any other immigration options for me??

Timeline

My Fiancé and I are not doing great and im worried it might end. We aren’t married just yet. Getting back into New Zealand is almost impossible right now with the COVID restrictions there ATLEAST until April-May. 

Is there any other option anybody could suggest for me, changing status of some kind if that’s even possible??

Well according to your timeline your fiance entered the US  a month ago, so you have 2 months to figure out the issue (if you don't know what it is already). I am assuming you are the petitioner and your fiance is the beneficiary? I am not sure what kind of status change you would be looking for other than having the clock run out. Sounds like you are wanting to fix it, is it fixable?

With a K-1, you are extremely limited.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

So sorry it's not working out. Unfortunately a k-1 visa does not allow to change your status in another way. You have to marry within the 90 days, otherwise you'd be out of status.

I don't think countries are denying entry to their own citizens.

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

I think NZ has a registry system for booking quarantine accomodations in advance.  No one, even NZ citizens, can travel back without that booking confirmation.  Apparently it's a long waiting list.

I’m very sorry it’s difficult for you guys right now.  Like others have said, unfortunately, there is no other avenue than adjusting status through your fiancé after getting married. 

It’s an adjustment at the beginning (not only immigration-wise…).  If you think there is any chance that you guys can still make it, I would try.  It would be a shame if the non-citizen went back to NZ to regret it as the immigration wait times will most likely not go down anytime soon…

@JoshandSarah, have you contacted authorities in NZ for special consideration?  I hope a K1 relationship going awry and threat of loss of immigration/visa status would qualify as urgent.

I heard that once a person waits and finally gets into NZ (even a citizen) there is a mandatory quarantine (under armed guard) where the people entering are forced to pay for a two-week quarantine in a fancy hotel.
