Got 10 year green card instead of 2,married for less than a year [merged threads]

Got my gc a month ago.I entered as a k1 and we got married and had our AOS interview under a year so I think we should have gotten a 2 year card.How to proceed with fixing it now ? I read about I90,can I file it online? Can I wait a month to file it while I get my driver license using it? If anyone has any personal experience please share and help me.

Yes, you may file the I-90 online.  No need to pay the fee because you're filing due to USCIS error.  You may use the GC until USCIS mails the envelope for you to send back the GC.

 

Also check the advice in the thread below.  Although the issue is opposite of yours, the advice given there applies to you as well, particularly about updating the notation on your SSN card and requesting an InfoPass appointment for an I-551 stamp in your passport --

Thanks for replying.Can I start this process after a month after I am able to get my driver license? Would delaying a month or more would cause any issues?

No issue with delaying for a month, other than possibly getting your corrected card later.  Just don't delay for too long, like years 😁

Varies...when my husband did an I-90, he kept the old GC until he got a letter (RFE) asking them to mail it back. They might ask you to mail it back sooner. If so, make an Infopass appointment and get the I-551 stamp in the meantime.

I wonder how you managed that. They told us we'd get a 2 year at our interview (haven't gotten the card yet). My wife is pregnant with our child and we provided good financial ties. Not sure what beyond that would make them give someone a tenner.

A mistake. Everyone married less than 2 years when the GC is approved, gets a 2 years conditional GC.

It's not on a case by case basis. There's a hard and fast rule to it. Married less then two years, two year card. Married exactly or more than two years by the time it gets approved, ten year card. It was simply a mistake in this case and it needs to get corrected or will lead to problems down the line.

It's actually a fairly common mistake on USCIS's part. Thankfully since it's their fault the hefty $455 $540 (including biometrics) I-90 fee is waived.

Got wrong card back in September,now filing I90 online,do I need to upload a copy of the green card with the form? Do I need to pay a fee? Or just fill the form on uscis.com and hit submit? Will I get an rfe for the original green card? Please share personal experience and help.Thanks.
