Switching for NVC to I-485

Hello,

 

I want to withdraw or close my case with NVC since I will be adjusting my status here in the US after getting (advance parole-parolee status) 

One of the questions on the I-485 application says" Have you ever applied for an immigrant visa to obtain permanent residents statys at a US embassy or US consulate abroad? YES OR NO

 

I have gotten my I-130 approved already but got a NVC case number how would I go on to close that case . can I send my adjustment of status packet before closing it my NVC case ?

Ask yourself, have you applied? I guess No.

Do not withdraw, just let the NVC know that you will be doing AOS with the uscis. You can file for AOS in the meantime.

You have not applied for a visa.  A petition has been filed and approved, not a visa application.

If you already paid the IV fee and submitted the DS-260 application form, answer "Yes".  If not, answer "No".

It would still be "No" if the case has never made it to an embassy/consulate or the interview scheduled. Even if DS-260 was submitted, NVC sends the package if still with them to the USCIS once it gets its request after i485 has been filed. Regardless does not matter anyway.

Hello Maria, I’m actually wanting to do the exact same thing you are doing. We are just waiting for our interview win Juarez but I’m wanting to see if maybe I can get advance parolee and fix my status from the USA since I have 2 little ones. How long did it take you to get the advance parolee?

I actually think otherwise, or at least I marked yes which a lawyer told me to do. I was also very confused, since I had started the process with the NVC, submitted all papers paid all fees and was waiting to hear back from them.  Then pandemic, border closures, etc... countries and I found myself in the US not knowing what to do. I was advised to let the NVC process pending and start AOS, since I had proof of no immigrant intent at my time of entry.

 

I filled the form with: Yes, in decision I wrote pending and in date I wrote N/A.

Once I filed AOS I notified the NVC with an online inquiry.

 

All my AOS package has been accepted,  received my EAD/AP and now I am waiting for the interview. Just so you know I didnt get an RFE for my answer.

As i understand it in order to file an AOS you must have a visa available which means you need a priority date which is current. The only way one gets that is by filing a 130 which you did. So that means yes. NVC will forward yourv  130 to the appropriate location. What I state applies i most instances but MAybe ADVANCED PAROLE IS DIFFERENT

Timeline

What field office was your advance parole at if you don’t mind?. I am waiting for both advance parole which I filed in March and my interview in Juarez with DQ sep 2019. I’m hoping I get my advance parole approved first but is stuck in Nebraska office.
