Green card information

Hi, how are you? I have a question I was married my ex-husband was a green card holder when we got married. He applies for his citizenship while we were married. I file for divorce and we were divorce. He ends up getting through with his citizenship. I'm I likely by any chance would get through with my green card even though I'm divorced now? Oh, we will have to get married again for me to get through?

There is no such thing as an ex-spouse visa

Not sure what you are asking.  If you are out of the country for a year or out of the country and the green card is expired, you no longer can enter the US.

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

What's your intent? Marrying your ex to be with him or just to get the GC. The latter is a fraud.

and you are in Cuba?

if so,  there is no way to proceed for a green card and to come to US thru him

No I'm not in cuba, and yes he put me down on the form but I didn't know he dd that and the married wasn't a lie

Where are you now?  If you are in the US, what is your current immigration status?  Did you legally enter the US, on what visa?  Did you start the green card process while you were still married to your husband, when he was an LPR but not a US citizen?  Details matter to give you the best advice and answers to your questions.  If you are not married to him anymore, you likely cannot get any US immigration benefits through him but it depends on the specifics of your situation so please explain more.  If you are in the US but not in any legal status, the best advice is for you to leave and go home, you are likely at risk of deportation.  How are you able to provide for yourself?  Sounds like a complicated case so we need more information to be able to help you.

Took me a good while to understand what you meant here. I was like "did she ask for a visa just because she was a spouse of a GC holder? Then I read again and finally understood what you were implying. 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Put you down on what form? Anyway if you didn’t get a green card while you were still married to him you cannot get one through him now. There is no valid relationship on which to base a green card. What status were you on in the US, or did you not stay there with him at all?

That would be immigration fraud.

You'd have to marry someone else.

 

There are two exceptions to this: widow(er) visa and VAWA.

Widow(er) visa (IW1/6) lets you self-file within 2 years if your US Citizen spouse died, but you must've been married at the time of death and have to prove that the marriage was legit while it lasted.

VAWA requires you to have suffered abuse from US Citizen or Green Card holder spouse. You have to prove various things for this: abuse happened with relatively low standard of proof, marriage was legit while it lasted, you lived together, etc. You can file while still married or within 2 years of divorce.

 

Neither seems to apply here.

How is that fraud again? We knows each other for 2 yrs. He was a GC holder so I couldn't stay. I decided to go back home because of work. And he did some stuff I didn't like so I decided again to divorce him. So I don't know why u saying it was fraud when u didn't even know me or us.

So we can't get married again this what u are saying.  We have work things out we have been talking since I called it off. And he has apologized for what he did in the past. And yes I have forgiven him.
