Submit I-129F now or later

Hi All!

 

My (beneficiary) fiancee (Filipina) is currently living and working in UAE.  We met in Dubai recently.

 

She will move back to Philippines late this year.  We would like to start the K-1 process (ie, file I-129F) now (ASAP), but are uncertain if her moving from UAE to Philippines after filing I-129F would cause complications/problems, or not.

 

Thanks for any advice you can provide.

Not an issue to file now.   Just know that you will need to get a police report fro UAE eventually.

June 13, 2018 Mary receives Mexican Residency Card

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Follow on question(s)...  so, would we need to worry about timing of the K-1 process vs timing of her move, to make sure the K-1 packet wouldn't go to UAE for processing?  Or, is there some (file update) mechanism to advise the agencies of these details?  Or, would we include some comments (e.g., will be relocating to Philippines on/about mm/dd/yy date) in the I-129F filing somewhere?

 

It just isn't clear to me how to make sure everything aligns, timing-wise, given that the I-129F would contain her UAE address, which will only be accurate for about the next ~5-6 months.

 

Sorry for the 20 questions...  just trying to get a grasp on this would play out, and/or how we would communicate, to make sure packet would be routed to proper embassy.

K1s are pretty backed up right now so if the intention is Manila - I wouldn't worry about that.  You can specify in the I-129F where she intends to interview.  And you can change that if wanted.

Nothing will happen even with the petition during that timeframe.  There are people with approved petitions who have been waiting over one year for an interview.  You've got a long road ahead.

Yes, unfortunately, we thought it would be a long road ahead, hence why we want to get the clock (process) started now, and not to wait.

There was a case for November filer because i filed in November 2020 too, Well, that was just like yours, fiancee in UAE but Pilipino, she has her interview today in UAE, That's how fast her process was cause UAE embassy don't have backlogs, cant say about Philippines

Can your fiancée renew her contract in UAE? If you don’t want to wait a very long time in the Philippines, that would probably be the quickest option.

You'd have to notify them that you're changing countries for the interview, and I believe the Philippines has many K1 visa applicants. If at all possible, try to get it done in the UAE while she lives there.

 

Not your question, but I'd recommend you get your UAE police report while still in the country. You can request it online using the Dubai Police website while still a resident, but once your visa is cancelled you will have to provide fingerprints at the UAE embassy in your home country and wait up to several weeks to get your cert.

You can file I-129F now and if you change your mind and get married, you can file I-130 and withdraw the I-129F.  I would file I-129F now.

File as fast as you can.  Highly recommended for your fiance to get a police report from UAE prior to her moving back to PI.

Re: Philippines interview vs UAE interview... By having her move back to Philippines, we were thinking we would be removing one potential complicating factor (i.e., work contract).  But, if there is a substantial difference in overall time to complete K-1 process... we might have to reconsider.

 

Re: UAE police report...  thanks for the tips/comments!
