Hi everyone! My husband (GC holder) and I (US citizen) moved to the US at the end of August 2020. We're filing MFJ for the first time in 2020 and are writing a statement asking for him to be considered a resident for tax purposes for the full year.  

 

My question is - does anyone know if my husband qualifies for the two 2020 stimulus payments, or would he only be eligible for stimulus payments issued after he moved here?

When did he get his GC? If it was in 2020 you don't need the statement electing him to be treated as a resident for the whole year.

 

Apart from that, yes he qualifies for all the stimulus checks.

Hi everyone,

 

After reading some posts on VJ, I thought I would receive the first and second stimulus checks if I have a valid SSN at the time of filing 2020 tax return (I received my SSN in May 3. and I filed on May 17 2021.). It turns out that my assumption is wrong.  Regarding the first and second stimulus checks, the taxpayers must... 

 

"Taxpayers must have had a valid SSN assigned before July 15, 2020, or October 15, 2020, if an extension was filed. If a joint return was filed and only one spouse had a valid SSN, a payment was issued for the eligible spouse and each qualifying child."

Internal Revenue Manual 21.6.3.4.2.13 (10)

This section applies to the advance rebates that were given out throughout 2020 (taking in consideration 2019/2018 returns) that's why it says July 15 2020, deadline to file 2019 return and SSN.

 

If you didn't receive the advance rebate, and you're claiming it on your 2020 return, it doesn't matter if your SSN was issued later.
