Hello everybody,

 

So my parents just got their visa and they are planning to come to the US this coming August. My mom wants to sponsor my brother after she gets her green card(DOB 05/2001). With the current status of F2A in the visa bulletin, do you think he will be protected under CSPA?

I am assuming your parents just received their IR5 visa?

 

After they arrive in the US, they can submit an I-130 for their son (your brother) and he would qualify for F2A if the form is received before he turns 21 (NOA1 date).  That is, as long as he remains unmarried.
