Super odd interview (merged)

Hey,

me and my husband had our interview almost 7 weeks ago. (Marriage interview, came with k-1 visa) 

We went there prepared and had everything with us. We were excited and confident. We have had really good and smooth visa process and easy k-1 interview.

No crazy backgrounds, no criminal history, no visa overstayes. Everything should be good and ”normal”. And if this matters but beneficial is from a ”good” country Sweden.

 

We arrive to the interview on time.

She comes to get us from the lobby, barely says hey and says ”I will take you separtely, you will wait in a lobby and I will take the American first”

She interviews him first for about 20-30 min and then me about 20-30 min also.

Really detailed questions, maybe 20 questions. She has a odd rude attitude.

 

We answered everything great, same answers. It was hard interview but same time easy for us cause obviously we live together and know each other well.

She said she can’t give us an answer yet and online says ”my interview was completed and my case must be reviewed”.

 

7 weeks and still nothing! Why did they do that? I can’t find any similiar stories. I have heard that they might separate couples while in a interview if it goes bad. But we never even got a change to do it together!?

Nothing to worry about.  Sounds normal to me. Be rude is part of the "experience " haha don't panic!

We had never heard that they would separate the couples right away, didn’t even get a change to do it together. That part made us worried.

Unless Sweden is different, the USC does not need to be there for the interview.

 

Just from reading about this case, I think that USCs should not attend interviews so the COs can't pull this stunt

OP's recent interview was for Adjustment of Status inside of the US. The I-485 interview notice states that both must attend (unless USCIS PM allows otherwise).

If people show up to their marriage-based AOS interviews without their spouse, I'd imagine the interview would be cancelled on the spot.

not sure where you got the info but  for Marriage based US immigration interview both spouse and applicant are expected to be there. It is a marriage based interview. Yes they are allowed to interview separately

It happened more frequently since Covid started so that alone is not a reason to worry.

It’s not the norm to be separated immediately but not unheard of. Hopefully your approval comes in soon. Sweden is probably top of the low or nonexistent immigration fraud list. 😁

Seems really odd they'd spend 1+ hour interviewing a seemingly straightforward case with the backlogs USCIS is currently experiencing. 😓

 

Perhaps it was some automated system that flagged something, or maybe they "grill" a random tiny minority of cases to keep applicants from getting too comfortable, kind of how the IRS will randomly audit a tiny percent of tax returns (in addition to those with red flags) to keep people honest.

 

One of my wife's friends got a stokes interview 2 years ago right of the bat - they spent 30+ minutes with each person. But their case was filled with red-flags. They still got the green card, and actually benefited since the long delay in approval got them the 10-year card.

Yes! Been waiting almost 2 months! They said wait 120 days and if nothing, then we can contact them.

Which leads to a question I’ve had is if someone has a bonafide relationship but they fail the AOS interview then what happens? Is there an appeals process or does everyone have to pack up and move out of the country? Or get divorced?  For myself it wouldn’t be a big issue as I have lived my entire adult life outside of the US and only returned because of the K1 requirements. We could just pack up and go to another country that I have citizenship or permanent residences at but most may not be in that situation.  However I’m sure this situation has come up before and I’m curious what couples have done.

Not common, but not unheard of.

Seriously if you have a straightforward case I wouldn’t worry about it.  Stay clear of these types in all circumstances LOL
