This is NOT Milligan v Pompeo. Currently, it's the Regional Ban Lawsuit.

It's being litigated by the same group(s): Siskind, Baxter and Aaron Hall (3 law firms). This is a support thread with updates.

 

In summary:

  • The argument is narrow--212(f) allows the government to restrict entry into the government but not cease visa adjudications/issuance.
  • It's not mandamus, meaning the attorneys are not asking an immigration judge to force the Dept. of State to adjudicate.
  • It's a mass-action lawsuit, as of now.
  • Any aggrieved plaintiff from the restricted country list was eligible to join with any visa type.
  • End goal: The Travel Ban is deemed unlawful OR the Dept. of State resumes processing visas (as allowed under COVID restrictions).

IMMpact Litigation posts updates Monday at 5PM EST visa Youtube, usually, and Dr. Siskind answers questions on Tuesday at 5PM via Facebook (Siskind Law Firm).

It's possible the court ruling in this suit could set a precedent. We don't know, it literally is history in the making.
