Filing Taxes During AOS

Timeline

The tax world is very confusing. My timeline is as follows:

11 July -arrived in US

1 Aug - married

8 Sept - Filed AOS

10 Nov - Biometrics

26 Feb - Recieved EAD

23 Mar - Recieved SSN

 

We want to file married filing jointly, but aren’t sure if I fit the requirements for a resident alien for tax purposes. Can anyone help us out with this? I worked in Canada up until my trip the US so I have some Canadian income (already filed Canadian taxes)

Have you checked the IRS website how to do a substantial presence test? https://www.irs.gov/individuals/international-taxpayers/substantial-presence-test

Biometrics Appointment Received by Mail...too bad I am in Europe right when it's supposed to take place 🤯 6/14/2021

Rescheduled Biometrics Appointment, the biometric technician can't change the misspelled name on file, but he enters the correct spelling of my last name as an alias 8/2/2021

Interview Ready to Be Scheduled 10/13/2021

(Two Days Later) Interview Was Scheduled 😱 10/15/2021

I-751 Interview, Petition Approved 🥳 11/19/2021

Case Status Changed to New Card Is Being Produced 11/19/2021

Case Status Changed to Case Was Approved 11/22/2021

Green Card Arrived in the Mail (Name Correctly Spelling, w00t) 11/27/2021

 

When USCIS Misspells Your Name:

 

Typographical error form filled on USCIS website 1/4/2021
Contacted USCIS if there has been any progress since THEIR error (Received a Tier 1 tracking number) 2/6/2021
Contacted USCIS again as the issue remains to be resolved (Received ANOTHER Tier 1 tracking number) 3/12/2021
Apparently USCIS chat is worthless; CALLED USCIS, Tier 1 agent promised that a Tier 2 agent would call me 4/28/2021
Received a call from a nice Tier 2 officer who said I may or may not get a correct extension letter, but just in case I would be scheduled an InfoPASS appointment 5/4/2021
Went to local USCIS service center and had to deal with a nasty and entitled customer service agent who refused to give me an I-551 stamp. National Benefits Center is supposed to mail me another I-797 within 7-10 days... So I had to waste my day, taking buses for two hours one-way just to deal with this lady's attitude? 5/7/2021

After anxiously monitoring our mailbox for a few days I DID receive a corrected I-797, w00t! All documents good to go Vaccinated Ready to visit my parents in Europe for the first time in 17 months!!  5/13/2021

The lesson: Don't use the chat for anything complicated, AND keep hassling USCIS for a response...

Since you are married, you'll be filing as married. Whether filing married separately or married jointly is your choice but it should be married, you shouldn't file as single since you are married. Most people file as jointly.

Removal of Conditions

02/06/2021: Filed and package sent

02/10/2021: Received by USCIS

03/18/2021: NOA 1

07/01/2021: Biometrics waived

09/27/2011: Case approved, no interview (K1 visa)

But if I file as married filing jointly, I don’t understand if I qualify as a resident or am still considered a non resident alien.

Based on your timeline you provided in the post, you should be a resident but please check substantial presence test from the link that @Locito  provided earlier to make sure.

If you are the spouse of a US citizen, you have the option to be treated as a US resident for tax purposes, regardless of the number of days you spent in the US during the tax year.  If you elect to be treated as a US resident, you must file jointly for that tax year.  Details here -- https://www.irs.gov/individuals/international-taxpayers/nonresident-alien-spouse

 

Whether you SHOULD take this option is a question for you and your financial advisor.

Even if you don’t qualify on greencard test or substantial presence, you still get the perk of being treated as a resident alien for tax purposes because of marriage to a USC. You are to write your own statement as described by the IRS, both sign, and include with your tax return. Your spouse will benefit from having you on the return, unless her income is super low like less than $12,400 which means she has no tax to pay anyway so she can’t get any lower than zero.  You may also qualify for the stimulus payments. Those are worked out on a worksheet for Line 30. Try TurboTax Deluxe that you download and  install or purchase on CD on sale. Then you can create various returns to try it out and just “save as”  with a different file name. Then you don’t have to eliminate the first to try a second.

Try using turbotax. They normally suggest the best filing (status) option for you. I'm a J-1 visa holder before but eversince we got married, We always file married filing jointly.
