So I just received the RFIE for my ROC and I am quite annoyed with it. The reason for the RFE was not enough evidence for a Good Faith Marriage.

 

This is what we submitted with the form:

Joint Tax Returns for 2018 and 2019

Joint Insurance for our Home and Car

Joint Mortgage Statement (we submitted the joint purchase agreement with my AOS)

Both Driver Licenses showing the same address

All of our Joint Bank Accounts

Pictures with us an my family, my wife's family and all of our vacations together.

Joint purchase agreement for our new car last year.

 

The RFE is saying that we do not have sufficient details showing shared responsibility of joint assets and liability, shouldn't everything I sent have been enough?

Hmmm.  Sounds like they lost your evidence.  I would send those same items along with evidence like a lease or property deed/living arrangements. It sounds like you sent reasonable evidence.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

They listed some evidence that I submitted, Bank Statements, Mortgage Statements, Photographs and Insurance Documents. They did say that I only submitted 2 months of bank statements and an insurance period of 3 months, which were the most recent periods prior to my filing.

 

I did use an attorney for this so I will have him review all this Monday to see what else we should submit, I have more than enough additional information I can submit.

The evidence should not just be from the most recent periods close to the filing date. They want it to be from the time you got married and/or started the account together up until the ROC submission. For example, if you opened a joint checking account in November 2017, got married in December 2017 and file ROC in December 2020, you should be submitting statements for the months of November 2017 to November 2020 or December 2020 (depending on when your bank issues the statement). They want to see continuity and pattern of an ongoing marriage. 

 

On the 2018 and 2019 tax returns, you should be able to download the tax transcripts by now from the IRS website. Some nitpicky officers prefer tax transcripts over tax returns. If you are submitting tax returns, these should be accompanied by the corresponding W-2s from each year.

 

Even if you have submitted the joint purchase agreement for a new house during your AOS, attach it with your joint mortgage statement when you are responding to this RFIE. 

 

At this point, if you have other additional evidence, I'd say throw them into the RFIE response package. Some people get approved with far less than what you have submitted but it's hard to tell to whom our case file would be assigned to when it reaches a service center. If we ended up getting a fussy officer, they are gonna scrutinize the sh-t out of everything and would want to see more. Not trying to peddle fear but that's my personal opinion. Throughout my immigration journey, I've always frontloaded for just-in-case instances. 

 

Fingers crossed that your RFIE response would meet the officer's requirements :)

ROC filed on December 1, 2020, assigned to SRC, approved within 106 days on February 18, 2021.

I think your issue is that you did not submit evidence from the time of your marriage.  It's a common mistake, but one that trips up a lot of people.  The instructions are quite clear about this.

 

Go back and hit them with the kitchen sink - even if you sent it in for AOS.

I did include our 2018 and 2019 tax returns and photos for almost every month in the 2 years of us going on different trips and photos with our families.

Regardless, I have a whole lot more information that I already put together so our attorney can send the response next week.
