My situation.......

 

Entered US on business visa.

 

Met a lady, fell in love and married.

 

Filed I-485 to change status.

 

I know it will take up to 2 years ( based on USCIS website estimate ) to get a decision and that does not bother me.

 

But, in the meantime my only ID is a UK passport with NOW EXPIRED visa. Although I am legally in the US whilst my application is pending, I have nothing to prove this.

 

DMV refused to renew my drivers license as I am unable to prove my status.

 

And I-485 receipt letter states "this letter does not grant status".

 

I called USCIS and they said there is NO document nor letter they can give me to produce to anybody enquiring whether I am lawfully in USA despite my expired visa.

 

Did any of you guys ever need to prove to DMV ( or anybody else ) you were lawfully here pending your I-485 application ?

This is a bit more detailed than your other thread, AP/EAD will be the first documents you get beyond the NoA. DMV is a State issue, I seem to remember some will accept a NoA, check also to see if your state does Drivers License for Illegals which you are likely to qualify for if you can not get a normal one.

Yes - ID DMV need EAD.

 

My old state of AZ were happy with b2 visa BUT dated exp date to coincide with visa expiry date.

 

Not sure if they accept NOA..........

As an AOS applicant, technically you have no legal status in the US, but you are in a period of authorized stay.  Your UK passport plus your I-485 NOA1 receipt notice serve as proof of that.  Until your EAD or GC approval, USCIS will not send you any other document to prove your status.

 

Do you have your EAD already?  It seems you'll be able to renew your license by presenting that, along with your passport -- https://itd.idaho.gov/starcard/acceptable-documents.html

 

Here's a post about another UK citizen trying to get a driver's license in Idaho, though there's no update on whether he succeeded --

Thanks for that.

 

My EAD is due very shortly ( biometrics next week and they usually arrive soon aftrr that )
