Hi! I’m sorry if this is in the wrong section. My soon to be husband and I are getting married here in Scotland! I’ll be flying back with him, for just over a week then coming back to Scotland myself. We won’t have started the process when I fly back with him but when I come back to Scotland, we’d then be looking to file for the CR1 visa! Has anyone ever visited their spouse before the process and is it okay? I’ve only seen stories of ones visiting when they’ve started the process. I have proof of ties etc and can show that to the officer on arrival, I know ultimately it is their discretion who they let in. I just wondered if people HAVE to file first etc.

You can visit, you do not have to file first before you visit, and as you said, it is up to CBP to actually let you in, so be prepared with evidence that you do not plan to stay (job/school commitments, return ticket, family, etc.).

Thank you sooo much! I’ve got a return ticket for 8 days later & a letter from my employer, stating my role and return date! I’ve got a really good travel history too, I normally would visit every 3 months but then the pandemic ☹️ I’m so excited to marry him! 💕

You should be good but of course it is always up to CBP.

Thank you Susie. I saw online it mentioned something about a national interest exemption, is that just for business travellers etc? or should I contact the embassy? Is the marriage certificate all I’ll need or should I phone the embassy too? Thank you!

London embassy specifically says don’t contact them about this.

  • Do not attempt to check in for your flight online if you have an ESTA registration.
  • Arrive early for your flight.
  • Carry any documentation that you believe demonstrates why you have been excepted from a travel restriction, such as a Permanent Resident card (commonly known as a Green Card), a marriage certificate, or a birth certificate, so that it is available if it is requested for review.
  • You may also wish to carry a copy of the Presidential Proclamation itself.
  • Your status will be reviewed in consultation with U.S. Customs and Border Protection (CBP) officials

Thank you so much Susie! I had seen something on the CBP site and it said about contacting the embassy but I think I read it wrong haha. You both have been very helpful. I’m so excited (and nervous). I’ve been visiting back and forth for years now but never as a wife and have just been really worried incase they were a bit funny about it but I’ll have all the documents needed to show them on arrival.

Different embassies have different rules about this, so it can get confusing.
