Hello, Everyone! 😀

 

Anyone here got approved visa under CSPA age? I'm turning 22 this Dec 28 and we are about to submit our DS260 maybe next day. My name is listed on the ceac website and able to pay the fees also. I also tried to calculate my age using the CSPA calculator and my age is 14 yrs 2 months 24 days.

 

Category: F4

Birthdate: 28 DEC 1998

PD: 02 FEB 2002

Approval date: 12 JUN 2009

WL received: 29 JUL 2020

Do we need to wait for our PD to become current or our PD is now current? Sorry Im a bit confused about pd to become current and Im also worried that I might be age out. 😓

PD needs to be current in the “final action dates” chart, Table A, on visa bulletin. So it is not current yet but that is at 1 Jan 2002 already so even with a backlog that might slow it down this coming year, it is very highly unlikely that it is going to take 6.5 years of actual time (the time it will take you to age out) to move one month on the visa bulletin...

Got it. Thank you so much for the help! Last question, does my age already freeze? Or does cspa will still apply to my case since our pd is not current yet? 😓

It freezes as at the date a visa is available for you, which is the later of petition approval or your PD becoming current.

Hello! Anyone here got approved visa under CSPA age? Does cspa still work? Our petitioned was filed Feb 2 2002 approved on 6/12/2009 and we received Welcome letter last yr July 2020. I'm 22 now, is there a big chance that I can still come with my family to US? We are in the process of submitting docs in ceac.

CSPA works in the F4 category by not counting the time it takes USCIS to approve the I-130 against children.  

In your case it took USCIS a little over 7 years to approve the I-130, so you have an extra 7 years.  This means you would not age out until you turn 28 years old.


Under CSPA, you will be able to immigrate with your family.

I'm in a similar situation as you, except I'm F3 and I just turned 21 two weeks ago. Take a look at the visa bulletin for March 2021, looks like both of our cases will be current beginning in March!

 

Just be careful that NVC doesn't accidentally take your name off of the case, in which case if they do, you can email them to have your name added back. I'm thinking about emailing them once March begins just to let them know that I turned 21 and to request CSPA, though I'm not entirely sure if this is necessary.
