Hi, 

 

I am filling out the I-944 Form. I am the Alien / beneficiary. I have worked in my home country and filed the tax return there. 

The form asks you to provide your most recent federal tax return but this applies only to whom has worked in the US....

 

What do I have to do?

Way back August this year, it was announce that I944 isn't required. We sent the AOS papers back then without it and then there was a decision made again that it should be required. We have received an RFE about it on 10.29, we sent our response back just Thursday. It's chaotic. If you wanna be safe, just send it with other forms if you really wanna be at ease. Other folks on August filers received their bio appt but then received an RFE for I944. Yep, crazy times! 

K1 Visa Adjustment of Status Timeline 
08/14/20 - AOS (I-485, I-864, I-765, I-131) sent to Chicago lock box

09/04/20 - Check has been cashed

09/11/20 - Received NOA

10/29/20 - RFE for I944 

11/10/20 - Response To USCIS' Request For Evidence Was Received

04/30/21 - Biometric Appointment

944 is still a mystery. Some people will say you need to send it. Some people will say to only send US tax returns.

 

You're gonna have to read the instructions and use your understanding to decide if you're sending it or not.

 

If you send it, it must be accompanied by a translation.
