My USC son has petitioned for me and the I-130 was approved on Oct 8, 2020 and case was received by the NVC.

I am putting together documentation to submit to the NVC and I have some questions.

 

Is it going to be an issue that I entered the US in 1986 on a B1 Visa and overstayed for 25 years? 

Are they going to ask me about it during the interview?

Can I be denied a visa for it?

 

I left voluntarily (not deported) and I have been out of the country 10 yea

 

This whole process is very stressful and I just want to be reunited with my kids.

I’d be surprised if they don’t ask you about it, but if you have completed the 10 year ban period (I think it’s still just a ten year ban for that?) that alone would not be reason to deny you a visa.

 

(1986 plus 25 = 2011 so you probably have not quite completed ten years yet? But may well have by the time you interview. When exactly did you depart?)

I guess I was there for only 24 years then...

I always talk about 25, but technically it was 24 I just realized :)

I think it’s pretty obvious you worked illegally if you were there for that long, no? It’s all part of the same being out of status. Things you’d need to be more concerned about if the ban period is over include any felonies, in the US or abroad.
