Hey guys,

 Sorry to bother you guys. 

  Been to the US since June 18 2017 Came on a K1.

 - About to remove conditions this early filing Dec 2020. 

 

 - However , I thought about Citizenship amd my early filing date using uscis Calculator is December 2020

 

  -  My green Card anniversary date is March 2021.

 

   Here is the problem. 

 

 I started filing the citizenship N400 form online, at some point the form said I wasn't eligible for Citizenship till December 2021. BUT, USCIS calculator says am I could file early as this December 2020.

 

   Will appreciate any inputs.

My understanding is that you’re eligible to apply 3 years after your green card was issued, so Dec 2021.

If your Green card expires in march of 2021 you need to file an I-751 in December 2020. March 0f 2022 would make the 3 year mark and N-400 you can file in Dec 2021.

The two two anniversary of your green card is March 2021.  
 

That means the three year anniversary of your green card is March 2022.  
 

You are not permitted to take your oath of citizenship before March of 2022.  
 

You are permitted to file an N-400 as early as 90 days before your three year anniversary: December 2021.  
 

Not that as long as you file your I-751 before your green card expires, you can file your N-400 in December 2021, whether your I-751 has been approved or not.

It's not about how long you've been in the country, It's about how long you have been a greencard holder. From what you're saying you were approved for your greencard in March 2019,  that means you're only eligible to file for citizenship in March 2022 (minus 90 days, and if still married to your US citizen spouse), as you have been an LPR for 3 years then.

 

You can never skip the ROC step. So file your i-751 in December as you had planned, and then you can file for citizenship a whole year later.

 

When you use the calculator you have to put in your 3 year anniversary date as an LPR to find out the date for citizenship eligibility, not the expiration date on your greencard as that's only 2 years.

Everything is based on the date your original green card was issued, the issuance date is on the CGC card.

 

By the two years anniversary of the issuance of your original green card you MUST file to remove the conditions on your conditional green card, i751 form You can file 90 days or less than before the conditional green card expiration date (Note not three months but 90 days or less). Note if you need a waver for divorce, widow, or abuse one can file i751 anytime

 

At the three year anniversary of the issuance of your conditional green card you can apply for naturalization n400 if you are still married and living with your spouse. You can file 90 days or less before the 3rd anniversary of the issuance of your green card. 

 

If you are no longer married to your spouse you must wait for the 5th anniversary of the issuance of your original green card to naturalize.
