Hello friends
I have a problem:
I received my Green Card in August 2020, and went to visit my family in Brazil.
And my husband took me to the airport, we were happy, until I realized that he had used it in bad faith, and he took the opportunity to say that he no longer wanted the marriage, and the solution would be divorce.
So, my husband, sent 2 boxes of my clothes to Brazil, without my consent, and without giving me the chance to return home in the USA.
We only have 10 months of marriage, and my Green Card is 2 years old, therefore the parole, until I am 10 years old.
He claimed that I was jealous, but I have evidence that we were doing very well.
I remember, he wanted to buy only the one-way ticket, and I asked him: why only one way ?? !!! And he didn't know what to say. So, he ended up buying the return ticket
Conclusion: I can, change the date of the trip, and the internship, so I can return to the USA.
Some claim that he was abusive in doing so.
We are married with a prenuptial agreement. I have no right to anything.
Has anyone been through this situation?

You have a GC you can use it he has no say you can remove conditions with a divorce waiver

Você tem um GC e pode usá-lo, ele não diz que você pode remover as condições com uma renúncia de divórcio

Thanks for request.

It doesn’t matter who is talking about divorce (actually better that he is because you can show you entered in good faith presumably) you have a valid greencard for two years. When it comes time to remove conditions you will file with a divorce waiver.

Thank you so much Luckycuds

So sorry that your marriage didn't work out.  From what you describe, he sounds like a bad apple so it's probably for the best in the long run.  You are a legal permanent resident of the US, and can file for your removal of conditions as soon as you have the divorce decree, with a divorce waiver there is no need to wait until the 90 days before the 2 year expiration date.  If you want to continue your life as an LPR in the US, I suggest that you return well before you are out of the country for one year, and figure out your life here without him, live wherever you want to, work, pursue a career or education, there are no limits on what you can do if you choose to continue as an LPR.  Your immigration status is out of his hands, it's all up to you now.  Find a good divorce attorney, with a prenup it will be pretty simple.  Get divorced and move on.  Save all the evidence you can find that the marriage was entered into in good faith, gather up records of joint bank accounts, joint lease or mortgage or deed, anything to show your marriage was bona fide while it lasted, so that you can submit all of that to remove conditions with the divorce waiver as soon as you get the final decree.  You could also choose to stay in Brazil if you want to, it's your choice.  Brazil is an amazing country too!  Take care of yourself, and good luck!
