I lost my jib recently due to covid 19 and still got no umployment yet(in the process). I do have a joint sponsor who is married and make suffitient income.another issue, I have 2 kids on my own one of them get claim by his father in tax return.

questio 1- which form the joint sponsor have fill out?

question 2- under the house hold number should i enter 4 (me, my 2 kids and my husband) or 3?

question 3- can i put the child support as an income for now?

question 4- I'm starting a business, should i check the box as a self-employed?

Answers:

  1. I-864
  2. 4 (both kids count regardless of whether one of them is claimed by their father or not)
  3. Will defer to others, I'm not 100% sure what the correct answer is.
  4. Will defer to others more familiar with self-employment and the I-864.

3, yes you can count child support if it is court ordered.  Document it with the court order or divorce decree etc.

4.  You can say you are self employed and show an occupation but until the income shows on a tax return, you have no income from self employment.  If you start a business, you no longer qualify as "unemployed".

If your joint sponsor filed as Married Filing Jointly, he should fill out form I-864 AND his spouse should fill out form I-864A.  So, you need to submit 3 forms: I-864 from you, I-864 from joint sponsor, I-864A from joint sponsor's spouse.

but  this is noted:

The IRS states unequivocally that child support payments are never deductible and that child support isn't considered income. Custodial parents should not include child support payments received in their gross incomes for tax purposes. 1 This is the case even if you claim your child as a dependent.

So the income from child support will not appear on the IRS tax transcripts and you will need to explain to NVC

and Casa embassy will look to the age of that child as one who is older like 16 or 17 could mean the support stops soon. (depending on child and continuing education )

Yes, child support is not on a tax return.  It is listed on the I-864 as part of current income and documented by both the court papers ordering it, and evidence one actually receives it, like bank statements, etc.

NVC will note that but this member needs to know Casa embassy only looks at tax returns as income -the AGI only / been the policy there for years

she should look to getting a  joint sponsor
