Me and my Boyfriend have 2 sons ages 5 and 7 years old. (We will process a spousal visa CR1 visa for me). My BF is an American citizen but didn't qualify for the residency years required in order to Pass on his citizenship to our kids. His father (Kids grand father is a US citizen and have met the residency required). We want to immigrate to USA from the Philippines with our kids.  We are not married yet and planning to get married  and we want to know how to proceed with our next step of N600-K form for the kids in order for us to permanently live there? 
Hoping to hear from you. Both the kids were born in the Philippines. Currently we are still residing here in the Philippines.

Don't bother with N-600k.  Assuming they meet all other requirements, the kids also need to be able to enter the US legally to attend the interview.  But with clear immigrant intent, it will be next to impossible for them to get B2 visas.  By the way, the current estimate for N-600k processing is 6 to 20 months.

 

Just get married and have your USC husband file I-130s like milimelo suggested.  It is the appropriate path for you and your kids to immigrate to the US.  After the kids arrive in the US, they will get an entry stamp on their immigrant visas and they become US citizens.  You can submit the stamped visa (with their Philippine passport) as part of the requirements to apply for their US passport and/or certificate of citizenship.

My children arrived in the US using K2 visa, they are my biological children, how will they acquire my US citizenship status? please help.

 

Background: 

I cannot apply for CRBA: Consular Report of Birth Abroad in the Philippines for our kids because I did not meet the 5 years residency requirements before they were born? I am half german, half american and I grew up in Germany. I only stayed US for 2 years before my kids were born. Currently, from 2020 to 2021 I am living and working in  USA. 
 
I believed that Child Citizenship Act of 2000 will grant my kids US citizenship upon arrival to USA. 
 
Their mother (my fiance is on a K2 visa).

They do not fall under CCA on a K visa, they need to first get  green cards /be LPRs to meet the requirements for automatic acquisition of citizenship.
