Hello,

Here is my situation and need help:

Facts:

1. Primary petitioner (let call her Jane) is USC and divorced; having 2 USC kids;  Jane's 2019 tax (1040) she claimed only 1 kid as dependent. (the other kid was a dependent on her ex-husband's 1040).

2. The principal immigrant/beneficiary is Jane's sister named Jennifer; Jennifer is married with 1 kid (under 21).

3. Jane's income doesn't meet 125% FPL.

4. I'm the only joint sponsor and my income meet 125% FPL for my household size which is 9 (6 from my own and 3 from Jennifer, her spouse and her kid). On my I-864 (the only joint sponsor) I checked the following 2 boxes:
Part 3, item 1: YES (I'm sponsoring the principal immigrant)
Part 3, item 2: I'm sponsoring the following family members immigrating at the same time w/ the principal immigrant.
 

Questions:

On Jane's I-864:

  • Does she have to fill Part 7 - User of Assets to Supplement Income ?
  • Given the fact that her income doesn't meet 125% FPL and having me as the only joint sponsor, does she still have to check the box Part 3, Item 2?
