I have h1b deadline coming up in 2 weeks and i got laid off because of pandemic. So i have to file this ASAP to stay in USA

how long does it usually take to receive and rfe or reject result after filing i130 and i485 from uscis.

And how much time do you get to reply to a rfe.

Wondering if renewed passport will be available by then?

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

First you need to figure out whether she is a wife or a GF, because you've written both, and that won't fly.

Odds of removal by ICE are very, very low. File when the US citizen has an unexpired US passport. Then after filing, AOS applicants are in a period of stay authorized by the Secretary of Homeland Security. You can file after your I-94 expires: https://www.uscis.gov/policy-manual/volume-7-part-b-chapter-8 "Immediate Relatives"

So,if i understand correctly,  I can stay in USA even after 60 days H1B grace period ends, And file for green card after whatever 2-3 months it takes to get renewed passport?

yes we just got married thats why the mixup. But we have been dating since 3 years. We are going to provide all the picture and messages as proof.

We had to expedite the green card process because i got laid off. 

yes we have marriage certificate. but not sure if i can stay in usa legally and wait for her renewed passport(several months due to covid19) and file i130 then.

There’s a good likelihood the AOS will be rejected if you don’t provide the required supporting documentation, e.g. USC proof of citizenship.. 

 

not sure being laid off is an acceptable reason to Expidite, but good luck with that

As long as spouse is a USC. You cannot work though until EAD has been received. Also, it will take not just 2-3 months for passport renewal -- more like several months now until they offer expedite service again.

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

You can stay in the sense you will be staying out of status however your out of status stay won’t impact your GC processing thanks to your USC spouse. As long as you don’t do unlawful activities during that time, it should be of no concern.

 

As i said, another option is to file the i130/AOS package now and see if they accept it. If they reject it now, no loss other than the shipping fees. If they accept it now, by the time you get RFE for valid passport copy, your wife will very likely have the new passport if she applies for the passport soon.

In general it would be lots of months before they even touch your file and i believe it’s 30-60 days or more in average rfe response deadline.
