You will have to get married and file a CR1- still would recommend more face time. You can not appeal a k1 denial; it is essentially dead.

Edited to add: I am in no way trying to be negative or deter you. It's just we see it here so often certain countries that it's a no brainer when more face time is needed. Since you are new to the process I think it would be best for you to do your best you can to present a strong relationship when you unfortunately, through no fault of your own & just for the country he is from, will have an uphill battle to fight. Please check out the Nigeria message boards too to connect with people who have gone through the K1 process with Nigeria. https://www.visajourney.com/portals/index.php?country=Nigeria read about their experiences and what they recommend. It's already so emotionally draining and financially draining (not to mention when politics is added as well) to be in a long distance/international relationship that no one wants to be dragged down even more with a denial or more time and money "wasted". Just remember what we all think of as "faster" isn't necessarily "better."

I definitely did not take your comment as negative. I appreciate the help and I know it is an uphill battle so I’m grateful for every foothold. Thank you for your sensitivity and support. 🙏🏻

It will be very difficult but we will try! The expense is enormous. 😭

Unfortunately, you’ve only just begun with the expenses of immigration. There are lots of fees and adjustment of status (AOC) after marriage is quite expensive. Not to mention your spouse will not be able to work for perhaps a year after coming to the U.S. while waiting for his employment authorization.  Best of luck to you two. It is a long journey, but definitely worth it!

Note that IV ban for Nigerians is still in place: https://www.whitehouse.gov/presidential-actions/proclamation-improving-enhanced-vetting-capabilities-processes-detecting-attempted-entry/ "The entry into the United States of nationals of Nigeria as immigrants, except as Special Immigrants whose eligibility is based on having provided assistance to the United States Government, is hereby suspended."

DOS page with info on potential waiver requests: https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/presidential-proclamation-archive/presidential-proclamation9645.html "How do the Proclamations address waivers?"

Yes, Nigerians can still be approved for a K1. The EO from February was for immigrant visas K1 is non immigrant visa. There is a thread on here for that ban if you would like further information.

Right, but the K-1 is not an immigrant visa.
