That’s required to fill and send forms for 90 days, but in immigration law of US here is no terms about that, just as soon as possible after wedding. People who sent later are fine.

We sent 6 month after, cause that is expensive.

it's only 1200-1500? How is that expensive?

But yes it is better to submit it as soon as possible because technically your spouse is out of status and you don't want to risk. Since you  got married in time and there is pandemic it should not really impact your AOS, so you shouldn't worry, but don't hold for too long

Hi all,

My fiancee came to USA on February 20th. We got married on April 18th (the delay was due to the pandemic). But it was fortunately within 90 days. However, we didn't get to send out the I-485 form within 90 days. We are freaking out because apparently that means my fiancee is no longer legal. We are working on finishing up everything and mailing it out very soon. What are the repercussions of us sending it out past 90 days?

Correct me if I'm wrong, but apparently the I-485 will take a year to process? If so, does that mean my fiancee won't be legal for that long? Will she be deported? How do we prevent that from happening?

We would appreciate any input. Thank you!

We arrived 12/27/19 married 12/29/19 applied 2/18/20, now K1 expired, no GC no EAD no AP.   We move around with Passport and I-797 NOA 1 receipt for I-485.   You need to apply ASAP to get the I-797, because without the NOA 1 for I-485, your wife can be detained and interviewed before released at immigration court or police station or ICE.  Eg:  traffic stop and you have no valid status so stupid policeman detain you and call ICE.
