Hello, I tried searching through the forum threads and looking in the Guides/FAQs, but I couldn't find answers to some of my questions.  If I could receive some help from someone who is more knowledgeable, I would greatly appreciate it.

 

Background:  My fiance has more than 1 child, but only 1 child lives with them and intends to immigrate.

 

1.  For a K-2 Visa, is there anything else I need to do aside from checking the question 39 box and filling out the child's information?  I know there are steps later down the line with interviews and such, I'm just asking about initially.

 

2.  Do ALL children need to be listed or just the ones that intend to come over on a K-2 visa, if approved?

 

3.  If yes to 2... what should we do if the Fiance doesn't know the address of the child.

 

4. Follow up from question 3... my Fiance is on bad terms with the legal guardian of the second child.  Will permission be needed from them in order to continue the K-1 process?

1/2.  For the petition,  you simply fill out  the information fir ALL children regardless of intent to immigrate

3.  Unknown 

4.  Nearly all consulates require permission for the child from the other parent in order to issue the Visa.  If the child is not immigrating then no issue

Q4 Depends on the country that you're immigrating from. Since you haven't stated or completed your profile this question is hard to answer definitively. Simple answer is yes, they will need something from the other parent.

 

We need a little housekeeping on your end. Many of our answers are predicated on the information you supply in your profile. 3. The child that she doesn't have custody of you can put Unknown in the address section or add an additional page at the end and state that child lives with  father location unknown. 

 

4. Nothing will be needed from the father as she doesn't intent to immigrate with that child.

Thank you.  This is what we were thinking, but wanted to see what other people have experienced.
