Need help please!!

Im a us citizen and i filed for a spousal visa for my wife back in Aprl 2018. We got married on Jan 2018. But i didnt know that i had to file a seprate petition for my son (2yrs old)  . So i was wondering what can i do to ensure that i can be whole with my family. 

 

Ps. I currently live in the states. They live in philppines.

So do you not qualify to pass along US citizenship to him?   If not,  you will submit a separate petition for him.

 

also- what’s the status of your wife’s petition?  April 2018 was nearly two years ago.

If you were a USC at the time of his birth, you can pass citizenship on to the child..

if you weren’t then submit a petition for him, with a request to expedite explaining what happened and your wife’s visa status.. they may or may not accept it and she may have to delay her visa whilst his is being processed

No i dont qualify because i wasnt in the US after i turned 14 . 

 

I only recieved NOA1 at the moment.

Timeline

Send the petition ASAP. Request an expedite after you receive the i-130 receipt number. Once it gets to NVC request another expedite. 

Cateogory: CR1

  • NOA1/Notice of receipt: Sept. 15, 2015
  • NOA2/I130 Approved: February 8, 2016 (NO RFE) :)
  • Process slowed down by us
  • Sent documents to NVC: April 11, 2016
  • Scan date: April 14/ May 7th (NVC said both I dont know why)
  • Case Complete: May 31, 2016 (No checklist) :dancing:

August 17, 2016: Visa Approved!!!! :dancing:

With the NOA1 contact USCIS and request an expedite so that your wife can come and support the family as well (financial reasons).   It doesn't cost anything to ask.  Just be humble and admit the screw up.

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well
